About this file
This document is a Justification and Approval (J&A) for use of other than full and open competition issued by the Department of the Navy, Military Sealift Command (MSC) Norfolk. J&A No. N10426Q7109 authorizes a brand name contract award to GEA Westfalia for oil purifiers supporting the USNS LENTHALL (T-AO 189). The procurement includes 5 lube oil purifiers, 10 fuel oil purifiers, and 5 oily water separator purifiers. The estimated contract value is funded by US Navy O&M,N FY26 funds with a required delivery date of June 15, 2027.
The statutory authority cited is 10 U.S.C. 3204(a)(1), permitting procurement from a single responsible source when no other supplies or services will satisfy agency requirements. MSC justified the sole-source award on the basis that GEA Westfalia is the original equipment manufacturer (OEM) of the equipment currently installed aboard the USNS LENTHALL and is the only manufacturer capable of producing purifiers that will fit modern commercial vessels and ensure ship safety. A sources sought notice was posted on the SAM website on March 24, 2026, which generated no competing offers. The contracting officer determined the anticipated cost to be fair and reasonable. MSC has no plans to compete future contracts for these supplies unless another potential source emerges. The J&A was technically certified and approved on April 6, 2026, by Thomas L. White III.

Navy Marine Corps Acquisition Regulation Supplement
MARCH 2026 (Change 26-03)
ANNEX 1 – JUSTIFICATION AND APPROVAL
J&A No. N10426Q7109
(CLASS) JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk
2. Description of the Action Being Approved: Award of a contract on a brand name basis for oil purifiers in support of the USNS LENTHALL (T-AO 189).
3. Description of Supplies/Services: The supplies MSC are procuring are lube oil, fuel oil, and oily water separator purifiers. The quantities for each are 5 lube oil purifiers, 10 fuel oil purifiers, and 5 oily water separator purifiers. The estimated value is being funded by US Navy O&MN
FY26 Funds. The required delivery date for this is expected to be June 15, 2027. The Production and Delivery Lead times for these purifiers require that they be purchased during FY26 with
FY26 O&M,N funds in order that they be produced and delivered on time to satisfy a critical need for MSC vessels on or about the middle of June 2027
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.
3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority: The material being acquired is no longer being produced to be readily available and fit on modern day commercial vessels. The brand name source GEA Westfalia (GEA) is the OEM of the equipment onboard the USNS
LENTHALL and is the only manufacture capable of producing the supplies needed to ensure safety of the ship.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: A sources sought was posted on the SAM website on March 24, 2026 and no other potential offeror showed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than
GEA to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition: For the reasons set forth in Paragraph
5, MSC has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
