About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition for the award of a purchase order to Lakeshore Systems, the sole provider of the Lakeshore Systems traveling crane installed on the USS FRANK CABLE (AS-40).
The J&A explains that Lakeshore Systems is the Original Equipment Manufacturer (OEM) and the only vendor with the technical data, drawings, and knowledge required to fabricate the necessary repair parts for the critical ship equipment. The anticipated cost for the supplies is determined to be fair and reasonable. The Military Sealift Command intends to post a combined synopsis and solicitation notice along with this J&A to award a firm-fixed-price purchase order to Lakeshore Systems upon submission of a technically acceptable quote. There are no plans at this time to allow for non-OEM suppliers for these types of supplies, but the agency will assess the feasibility of future competition if another potential source emerges.

J&A No. N10425Q2131
JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk
2. Description of the Action Being Approved: Award of a purchase order on a sole source basis to the sole provider, Lakeshore Systems (Trident Maritime Heavy Equipment), of the Lakeshore
Systems traveling crane installed on the AS Class Ships, for repair parts to return the crane to fully operational. Lakeshore Systems is the Original Equipment Manufacturer (OEM) and sole provider of the required parts for the upcoming availability for the USS FRANK CABLE (AS-
40), using other than full and open competition.
3. Description of Supply Services: Provide the traveling crane parts to replace the parts for the
USS FRANK CABLE (AS-40) to ensure the item is available for the upcoming ROHDD availability. The estimated dollar value is which will be funded utilizing fiscal year 2025 Navy working capital funds.
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.
3204(a)(1) Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Authority: The traveling crane is considered critical ship equipment per regulations and is maintained under critical ship equipment document N0750-
100.00-AQ. The new traveling crane parts will replace the existing in form, fit, and function. The parts from Lakeshore Systems would be a one-to-one swap with all warranties from the OEM.
Lakeshore Systems owns the proprietary drawings and manufacturing processes for the installed equipment and all repair parts for the traveling crane. Lakeshore Systems is the only vendor with the adequate technical data, drawings, and knowledge of the crane, to be able to fabricate these items as required to repair the crane. Lakeshore Systems sells direct to the Government; there are no authorized distributors who sell on behalf of Lakeshore Systems.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: No sources sought was posted for this requirement as there is sufficient historical data showing that
Lakeshore Systems is the sole distributers providing Lakeshore Systems brand name parts.
Specifically past Lakeshore Systems sole source Request for Quotations (RFQs) have produced no additional vendors who have provided quotations. Lakeshore Systems sells to the Government direct. MSC perpetually seeks submissions from non-OEM contractors for consideration of qualification of their parts and/or services as an acceptable alternative to the OEM at https://www.msc.usff.navy.mil/Business- Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/. The Government intends to post a combined synopsis and solicitation notice along with this justification at the Government Point of Entry with the intent of awarding a firm-fixed-price purchase order to Lakeshore Systems Company upon submission of a technically acceptable quote.
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. Actions to Removed Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
