Summary

This is a Memorandum to the File documenting a justification for use of other than full and open competition for a simplified acquisition under FAR Part 16.505(b)(1). The procuring activity is the Marine Corps Tactical Systems Support Activity (MCTSSA) Cyber Assessment Branch of the Test and Engineering Division, which requires a DCO hardware kit from Sealing Technologies LLC for conducting cyber assessment, testing, and evaluation activities to ensure Marine Corps Command, Control, Computer, Communications, Cybersecurity & Intelligence (C5I) systems are cyber-resilient.

The specific item is the SealingTech Defensive Cyber Operations Kit (MCTSSA DCO Kit Case, Part Number SealingTech 3U Case), Quantity 1, with an expected delivery of 180 days after receipt of order and a requested contract award date of 29 September 2026. The justification for restricting competition to a single source is based on brand name requirements under FAR 13.106-1(b)(1)(i). The Government determined that the SealingTech DCO Kit is uniquely capable of meeting operational requirements due to Sealing Technologies LLC's proprietary hardware configuration, engineering design, and technical expertise. The memorandum states that no other manufacturer provides a commercially available hardware solution that replicates the current Program-of-Record configuration while maintaining interoperability with fielded Marine Corps DCO systems, and that introducing alternate platforms would require significant engineering analysis, compatibility testing, operator retraining, and validation activities while increasing technical and schedule risk.

Requested Award Date, Delivery, & Period of Performance:

Requested Contract Award Date: 29 September 2026

Delivery: 180 After Receipt of Order

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED ON THE

FOLLOWING:

A. ___ ONLY ONE RESPONSIBLE SOURCE:

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the

Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. ___ OTHER REASONS.

B. _X_ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

The SealingTech Defensive Cyber Operations Kit is uniquely capable of meeting the Government's operational requirements

Sealing Technologies LLC possesses the proprietary hardware configuration, engineering design, and technical expertise necessary to provide this capability. The SealingTech DCO Kit has been specifically engineered to integrate with existing Marine Corps cyber infrastructure and support operational testing requirements.

Introducing alternate hardware platforms would require significant engineering analysis, configuration changes, compatibility testing, operator retraining, and validation activities while increasing technical and schedule risk.

The Government determined that no other manufacturer provides a commercially available hardware solution that replicates the current Program-of-Record configuration while maintaining interoperability with fielded Marine Corps DCO systems. Accordingly, restricting this procurement to Sealing Technologies LLC is necessary to maintain mission readiness, ensure operational compatibility, and minimize lifecycle risk.

C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. If appropriate, include any additional pertinent information.

IV. CERTIFICATIONS/APPROVALS:

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
