About this file
Summary
This is a Justification and Approval for Use of Exception to Fair Opportunity (J&A) document issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia. The document approves a non-competitive award of additional work under Firm Fixed Price (FFP) Delivery Order No. N5005426FL007 to Colonnas Shipyard Inc. The additional work addresses critical repairs to the USS TORTUGA (LSD-46) that were identified after initial work package development and must be completed as part of ongoing EMAV (Extended Maintenance Availability) operations at Norfolk Naval Base.
The required work consists of bilge cleaning and jacket water system preservatives removal aboard the USS TORTUGA, estimated at a specified amount under FY26 Operation and Maintenance funds. The Contracting Officer determined the costs fair and reasonable based on historical data, Independent Government Estimate, and Project Manager technical knowledge. The statutory authority for this non-competitive procurement is FAR 16.505(b)(2)(i)(A), justified on the grounds that the agency need is so urgent that fair opportunity procedures would cause unacceptable delays of at least 30 days. Colonnas Shipyard Inc. possesses required equipment and is the only company able to meet the Government's immediate requirements while maintaining integration with the existing work package and Key Event Work Complete milestones. Market research was not conducted due to the critical and time-sensitive nature of the repairs.

7. ACTIONS TO REMOVE BARRIERS TO COMPETITION
For reasons set forth in paragraph 5 and 6, market research was not conducted. The critical nature of the work requires that it is started immediately. Future acquisitions for similar work will be reviewed by the Contracting Officer on a case by case basis to promote the use of full and open competition in the acquisition process where possible under this multiple delivery-order contract, where possible and practicable in accordance with FAR Subpart 16.5. In addition, a copy of the change(s) covered by this justification will be forwarded to Code 200, Planning and Engineering, and Code 300 Waterfront Operations for consideration of similar work requirements in future solicitations.
