About this file
This document is a Justification and Approval for other than full and open competition for a sole source contract award. The Department of Veterans Affairs awarded an indefinite-delivery indefinite-quantity contract to Broomfield Skilled Nursing and Rehabilitation Center, LLC for community nursing home services for veterans in the Aurora, Colorado area. The five-year contract has an estimated value of $25.3 million and a period of performance from February 1, 2024 through January 31, 2029. The services required include short- and long-term rehabilitation, nursing, and clinical care for veterans in accordance with regulatory and agency standards. Market research found no other capable providers in the area, and relocating the 33 veterans currently served would disrupt continuity of care. Therefore, this sole source award to the incumbent was justified.

A Sources Sought announcement, 36C25923Q0166, was posted on Contract Opportunities on December 30, 2022, and closed on January 13, 2023. There were no responses to the source sought notice. A search of the Medicare.gov, Vendor Information Pages (VIP), SBA Veteran SB certification (VetCert), and SBA Small Business Dynamic Search was conducted. A search was conducted using Medicare.gov nursing home compare website to find nursing homes in the Broomfield, Colorado area.
There are fifteen (15) Community Nursing Homes within 10 miles of the zip code of 80020 in Broomfield, Colorado. While this shows there are fifteen (15) facilities within the same area code, Broomfield Skilled Nursing and Rehabilitation Center LLC is one (1) of these fifteen (15). There are two (2) other VA contracted facilities. These two (2) facilities are not being considered due to being at capacity and the Veterans’ preference to remain at the Broomfield Skilled Nursing and Rehabilitation Center LLC. The other twelve (12) facilities have not been vetted through the VA process to establish them as VA contracted facilities nor have expressed interest in a contract. Also there are currently thirty-three (33) Veterans at the current facility that do not want to be relocated. They want to stay at that facility and be within close distance to their family. In those 125 results, it was a mixture of Community Nursing Home providers, staffing agencies and other NAICS code 623110 business types and the listing is for all nationwide locations. A VetCert scan on the 125 SDVOSB/VOSB was completed to see if any results were located in Broomfield, CO and came up with 0 (zero) results. As a part of the acquisition process, a CNH must provide a current state license, insurance, and a copy of the state inspection. These documents are provided to the CNH Program Coordinator for review and evaluation. The CNH Coordinator will either provide a recommendation to contract or state that the CNH did not receive a recommendation to contract. A redacted J&A will be posted on Contract Opportunities.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The estimated cost is anticipated to be considered fair and reasonable. This determination is based on Medicaid rates established by each state based on national average and also, the annual maximum allowable percentage that is published through the VHA Procurement Guide and VA Pulse by the VA Geriatrics and Extended Care Office. The annual maximum allowable percentage is applied to each Resource Utilization Groups (RUGS) IV category. The RUGS IV category identify the different levels of treatment. The add-on percentages are added to the basic Medicaid rate then applied to each RUGS IV category. The Medicaid rate and the VA add-on percentage make up the per diem rate paid for each Veteran. The line item structure will illustrate the different RUGS IV category, the add-on percentage, and the total per diem rate for each level of care. The facility will not offer services to

After conducting research on the current Medicaid and RUGS IV rates, the Contracting Officer (CO) will evaluate the Offeror's rate to determine if the price per diem rates are fair and reasonable. If not, the Government will negotiate a change in the rate based on the allowable add-on percentage established by the Office of Geriatrics and Extended Care. The add-on percentages do not change through the life of the contract.
