JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWCAD) Patuxent River, MD
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves the issuance of a Firm-Fixed
Price contract action on a sole source basis to Green Hills Software LLC; 30 W Sola Street, Santa Barbara, CA 93101-2508 for the procurement of AdaMULTI and INTEGRITY-178 tuMP software and licenses. These toolsets are in support of the H1 NISE SSA Project that support development of the operational flight program for the H1-Y and H1Z. The procedures of FAR
Part 12 and Part 13.5 will be utilized for this sole source acquisition.
3. Description of Supplies/Services.
The requirement includes the purchase 2 AdaMULTI Software Development Environment licenses, 2 GHS PowerPC C/C++ cross compiler licenses for INTEGRITY-178 tuMP targets, 1 license to use Green Hills INTEGRITY-178 tuMP RTOS, 1 license to use Green Hills’ PJFS-178
Safety-Critical File System, 1 license to use Green Hills’ GHNet-178 TCP/IP network stack, 1 license to use Green Hills’ NFS Client for INTEGRITY-178 tuMP, 1 license to use Green Hills’
IPSEC/IKE network stack and GHNet-178, and finally annual software maintenance for each of the items previously listed. This requirement will allow H-1 NISE to set up a Software Support
Activity for setting up software development of H-1s Mission Computer software for organic sustainment.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.
The H-1 NISE effort is tasked with setting up a Software Support Activity for software development of the H-1s Mission Computer Software. To facilitate the transitioning of the software from the vendor to NAVAIR for organics sustainment, NAVAIR must acquire the tools used by the vendor to build Mission Computer Software.
The current H-1 Mission computer is built upon the INTEGRITY-178 real-time operating system by Green Hills software and is built with Green Hills Software tools and compilers. Green Hills is the sole developer and does not offer products through resellers. Purchase of their proprietary items must be done through Green Hills Software and accompanied by a License Agreement.
Changing the real-time operating system would require significant re-architecture and would not provide any performance enhancements. This would introduce the risk of additional defects and could exceed the cost of the FY2012 H-1 operating system change.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Sources Sought was publicized on 25 March 2022 on the SAM website to determine if there are any interested parties who could meet the requirement. As a result, no other sources expressed an interest in the requirement. In accordance with FAR Part 12, a Notice of Intent will be posted on SAM.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402(a), the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An analysis of proposals will be performed by the Contract Specialist. As discussed in this paragraph, the
Contracting Officer will use price analysis as the basis of determining the price as fair and reasonable for the supplies covered by this J&A. Information related to prices including established catalog prices and previous procurements for commercial and Government purchases will be utilized in justifying a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
The H-1 NISE Team will continue to conduct market research for products to evaluate emergent technologies and architectures that would allow future competition. At this time, Green Hills
Software LLC is the only source that meets the Government’s requirements and the sole provider for the required product. If another potential source emerges, the H-1 NISE Team, in conjunction with the NAVAIR, will assess whether competition for future requirements is feasible.
