SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE

SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION

JUSTIFICATION.

The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Short Range Recovery (SRR)

Division has a requirement to purchase spare parts on a sole source basis utilized on the MH-65 helicopter.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

This procurement is for the following spare parts to be utilized on the MH-65 helicopters:

One (1) ChipCHECK Model CC122 Portable Chip Debris Analysis System. System shall include 1x debris analysis unit, 1x sample tray, 200x sample patches, 20x sample patch storage cases, 1x calibration standard, 1x standardization standard, 1x User information (Operations) manual, 1x transport case, Airbus Material

Library (Loaded on the unit) training course, and Shipping and Handling.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES

OR SERVICES CAN BE USED.

This acquisition is restricted to the only source(s) of supply known to have the capability of furnishing the required services. The USCG has determined that the required service can only be acquired directly from the Original Equipment Manufacturer (OEM), Gastops LTD, Cage Code (0DGD9). Furthermore, the

Government does not have adequate data or lacks right to data, and it is not economical to buy the data or rights to the data.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

The system to be procured under this acquisition is a highly specialized system, designed and manufactured by a non-Government activity and the technical data required for acquisition by other than the OEM or an

OEM approved sources is not available. Gastops LTD is the OEM for the products and services under this requirement and is the only USCG authorized source of supply for this requirement.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

The products and technology are proprietary and patented by Gastops LTD and is currently the only

Debris Analysis unit approved by Airbus to be used on the MH-65. Because of this, many of the capabilities, features, and products are completely unique to Gastops LTD. Having this unit onsite will allow the Coast Guard to analyze chip samples onsite and in accordance with an Airbus specific material library. Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND

OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The USCG does not possess the maintenance rights or technical information to provide to potential sources and this information must be obtained directly from the OEM.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

The OEM owns the proprietary data rights, patents, specifications, and drawings for this system which limit the USCG’s ability to provide adequate technical descriptions to potential new manufacturers.

Therefore, it is difficult to take steps to foster competition as the maintenance, data and repair criteria are proprietary to the OEM.
