About this file
This Justification and Approval (J&A) document is for the Department of the Navy's Military Sealift Command (MSC) at Norfolk, seeking to award a firm-fixed price contract for Boll and Kirsch parts supporting the USNS Gruman (TAO 195). The specific requirement is for a Lube Oil Purifier replacement, which must come directly from Boll and Kirsch as the original equipment manufacturer (OEM) or an authorized distributor. The procurement will utilize Simplified Acquisition Procedures for parts not exceeding $7.5 million, with the government intending to issue a synopsis/solicitation on www.sam.gov for a brand name, limited-source acquisition where parts must be direct replacements compatible in form, fit, and function with existing equipment.
The J&A notes that while competitive subcontracting is not currently planned, MSC remains open to assessing future competition if another potential source emerges. The Contracting Officer has determined the anticipated cost to be fair and reasonable. If the prime contractor identifies an alternate source with equivalent technical expertise and access to OEM parts, they must submit supporting documentation to the Contracting Officer by the solicitation's clarification closing date. The statutory authority for this non-competitive approach is derived from 41 U.S.C. 1901 and Section 815 of the National Defense Authorization Act.
