- Energy Management System Preventative Maintenance
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The Energy Management System (EMS) is the overarching system that manages and oversees all systems that comprise the Building Automation Systems (BAS): Niagra, existing (discontinued) Barber Colman Network 8000 control system including Global Control Modules “GMC”, network controller and Micro-zone, air handling units to new existing CM3 I/A series. CM3 is the original BAS developer and installer of the BAS equipment at the Philadelphia VAMC and Coatesville VAMC.
The hardware is proprietary to Schnieder Electric, which is then sold to CM3 under an exclusive agreement. CM3 is the only vendor authorized by Schneider in Southeastern Pennsylvania. The software is sold from Schneider Electric to CM3. CM3 then customizes the software by creating databases, graphics and programming tools. The integrated platform is proprietary to CM3. In addition, CM3 is an independently owned field office for Schneider Electric. Shcneider Electric manufactures the Schneider Electric I/A Intelligent Automation System solely for CM3. CM3 provides the I/A line and other diverse solutions which incorporate manufacturer’s proprietary BAS into a web based platform. In addition, the I/A and Barber Colman lines installed throughout the facility are propriety product lines and require factory training, support and software tools that are only available to CM3.
Due to the ongoing needs of the Veteran beneficiary population, the Philadelphia VAMC needs to maintain the integrity of the physical plant services necessary to keep the hospital running. The oversight and preventative maintenance of the BAS is necessary. Currently, the Philadelphia and Coatesville VAMCs have both obsolete and upgraded equipment as part of the BAS. With the obsolete, outdated equipment, only CM3 can provide the necessary service. The upgraded equipment within the BAS also needs regular maintenance. Without this requirement, a disruption in services could result in increased health risks and possible serious injuries to Veterans and employees at the Philadelphia and Coatesville VAMC.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
No other potential sources are available due to the proprietary nature of the required services.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
t was most recently performed on contracts Philadelphia) and (Coatesville). The most recent options were not exercised. Instead, a new five-year

See paragraph #5 above.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Only CM3 expressed an interest in this procurement due to the proprietary nature of this requirement.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required:
Due to the proprietary nature of the Energy Management System, the only option would be to completely transition from the current system to another Energy Management System. A change in vendors would require the removal of control modules, ancillary equipment and software, and the installation and programming of a new system. This would result in a substantial delay in meeting the Philadelphia and Coatesville VAMC’s Energy Management System needs safely and efficiently and would be cost prohibitive. The Philadelphia VAMC could not expect to recover the cost of the installation of a new Building Automation System which is estimated at .
When the existing Energy Management System no longer meets the Philadelphia and Coatesville VAMC’s requirements, additional market research will be conducted for a replacement solution.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
