About this file
This document is a Justification and Approval (J&A) for a sole source contract issued by the Naval Surface Warfare Center, Indian Head Division (NSWC IHD). The contract is for the procurement of up to two advanced oxidation photocatalytic plus (AOP+) reactor systems from Purifics Water Inc., located in London, ON. The unique pollution control system requires a specialized reactor that can capture and destroy nitroglycerine, and Purifics is the original equipment manufacturer with deep expertise in the facility's specific environmental requirements.
The contract includes the AOP+ reactor systems with a patented Ceramic UltraFiltration (CUF®) unit and original equipment manufacturer in-factory training for government employees. A Sources Sought notice was posted on SAM.gov from July 1-16, 2025, and a synopsis was posted from July 17 to August 1, 2025, with no responses received from industry. The authority to act under this justification expires on September 30, 2026. The total estimated cost is redacted, with funding type listed as NWCF (Navy Working Capital Fund) for fiscal years FY25-FY26.

The minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) IAW FAR 6.302-
5. Rationale Justifying Use of Cited Statutory Authority.
The pollution control system (PCS) currently installed is a design unique to the facility. Due to environmental considerations, the system was built to capture and destroy nitroglycerine that evaporate in the ovens. Due to the unique nature of this system, any AOP reactor the Government uses must go through sufficient testing to determine if the reactor is able to meet requirements. This would be required of any company that is not able to provide sufficient evidence of being able to meet our need. As a result, the companies would be required to prove their efficacy through a pilot scale experiment or showing results of an existing system that is similar in nature and function. Purifics has a deep knowledge and expertise of our system and its requirement as they were the company that designed and built the legacy pollution control system. Purifics has shown that they are able to meet our requirement over the life of our annealing facility.
The proprietary Purifics Photo-Cat® AOP+ reactor system includes a patented Ceramic Ultra- Filtration (CUF®) unit. This filtration is important for keeping the proper catalyst concentration within the reactor system flow passages. Without the recirculation of catalyst, the catalyst concentration will decrease below effective range producing undesirable intermediates and allows the catalyst to build up in the PCS creating deposits of the catalyst material. This reactor system does not require the addition of chemicals, such as hydrogen peroxide or any other adjuncts, which are known to cause undesirable intermediates that clog the system.
Purifics, Inc. cites the following patents: #5,462,674; #5,554,300; #5,589,078; #6,136,203;
#6,215,126B1; #6,398,971B1; #7,008,473B2; #7,326,278B2; #7,425,272B2; #7,588,688B2;
#7,800,310B2; #7,837,952B2; #9,259,502B2; #9,133,047B2; #8,491,789; #10,071,927;
#10,005,686; #10,315,935.
If the government were to test any other technology discovered or offered, it would take approximately 545 days and $1M. These costs are not expected to be recouped by competition and would create unacceptable delays in meeting fleet requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with DFARS PGI 206.302-1(d), a Sources Sought was posted on SAM.gov on 1 July 2025 and closed on 16 July 2025. No responses were received from industry.
A synopsis was posted to SAM.gov on 17 July 2025 and closed on 1 August 2025. No responses were received.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC IHD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC IHD will assess whether competition for future requirements is feasible.
