2. Description of the Action Being Approved.
This Class Justification and Approval (CJ&A) authorizes and approves the issuance of orders on a sole source basis under a Basic Ordering Agreement (BOA) with ERAPSCO, 4868 E Park 30 Drive Columbia City, IN 46725-88. These Engineering Support Services (ESS) and Research and Development (R&D) orders will be for the continued development and procurement of
ERAPSCO AN/SSQ production sonobuoys. Authority to act under this class justification expires 31 October 2025.
3. Description of Supplies/Services.
PMA-264 requires continued ERAPSCO production sonobuoy and intends PMA-264 intends to leverage ERAPSCO’s sonobuoy expertise for sonobuoy improvements on current production
ERAPSCO sonobuoys.
ESS efforts include the mitigation of technological obsolescence of current production sonobuoy designs and components through continued analysis and the integration of upgrades and new technologies to support modernization of the current production sonobuoy configurations. The engineering services will be performed on the following production sonobuoys produced by
ERAPSCO;
AN/SSQ-36: Bathythermograph (BT) sonobuoy
AN/SSQ-53: Directional Frequency Analysis and Recording (DIFAR)
AN/SSQ-62: Directional Command Active Sonobuoy System (DICASS)
AN/SSQ-101: Air Deployable Active Receiver (ADAR)
AN/SSQ-113: Navy Underwater Active Multiple Ping (NUAMP)
AN/SSQ-125: Air Deployable Low Frequency Projector (ADLFP)
*AN/SSQ-125A: Air Deployable Low Frequency Projector (ADLFP)
*The AN/SSQ-125A variant is also manufactured by Lockheed Martin under a multiple award IDIQ contract This CJ&A and ESS/R&D contract only applies to the ERAPSCO manufactured sonobuoys procured by PMA-264.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), One source or limited sources.
5. Rationale Justifying Use of Cited Statutory Authority.
The only prospective source for the R&D and ESS efforts for the ERAPSCO AN/SSQ series production sonobuoys is ERAPSCO, Inc. ERAPSCO is the sole designer, developer, and manufacturer of the proprietary ERAPSCO AN/SSQ series production sonobuoy designs. No other source possesses the knowledge and expertise of the ERAPSCO proprietary design and manufacturing processes necessary for successful performance of the required efforts.
PMA-264 does not currently have technical data rights for any of our production sonobuoys.
Current production procurements require the manufacturer(s) to build sonobuoys to a
Government provided performance specification, which limits the Government’s data rights due to how the sonobuoys were developed. Additionally, since sonobuoys are expendable devices and do not require maintenance or sustainment, the Government does not have a requirement to procure a Technical Data Package (TDP). This BOA will be for ESS and R&D efforts for existing sonobuoys, therefore, the procurement of data is not anticipated.
In accordance with FAR 6.302-1(a)(2)(ii)(B), the Government has determined the supplies meeting the Government’s requirements are available from only one source because it is likely that award to any other sources would result in unacceptable delays in fulfilling the agency’s requirements. The efforts under this contract include modifications to current qualified
ERAPSCO designs and therefore, cannot be completed by another contractor without significant, unacceptable schedule delays to the Government. A new buoy would have to be developed, qualified and produced to the new requirement, which is anticipated to take five years.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with FAR 5.201, a Sources Sought Notice for this requirement was posted to beta.SAM.gov on 14 February 2020 with a closing date of 28 February 2020. The Government did not receive any capability statements in response to the Sources Sought Notice.
Additionally, in accordance with FAR 5.201, the proposed contract action was synopsized on the beta.SAM.gov website on 15 April 2020 with a closing date of 01 May 2020. No other potential sources expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than ERAPSCO to provide the required supplies and services. Orders will be individually synopsized in accordance with FAR 5.201.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer must purchase supplies and support from responsible sources at a fair and reasonable price. Technical analysts and contract specialists will perform an analysis of the proposals, with the assistance of Defense Contract Management Agency
(DCMA) and Defense Contract Audit Agency (DCAA) auditors as needed at the Order level. The
Contracting Officer will analyze the various cost elements that are presented in proposals; as well as review the actual cost elements from previous procurements, if applicable. The Contracting
Officer will use Government expertise, including DCMA, DCAA, the program office, and other
Government resources, to evaluate the material, labor and subcontract positions. As discussed in this paragraph, the Contracting Officer will use cost and price analysis as the basis for negotiating a fair and reasonable price for the supplies/support covered by this CJ&A.
8. Actions to Remove Barriers to Future Competition.
The Government does not anticipate procurement of sonobuoys on a sole source basis via
ERAPSCO post FY23. Currently, there is an acquisition strategy to compete all sonobuoy variants in FY22. This BOA will allow for ESS and R&D throughout the life of the current sonobuoy production contract with ERAPSCO through FY23 with deliveries completing in
FY25.
