About this file
This is a Request to Restrict Competition memorandum from the Naval Surface Warfare Center Carderock Division seeking approval to restrict competition for a brand-name acquisition under FAR Part 12 procedures. The memorandum is dated August 26, 2026, with PID N00167-26-SIMACQ-CD-61-0127, Requiring Code 617, and is classified as Controlled Unclassified Information (CUI).
The procurement involves one PerkinElmer Lambda 1050+ Spectrometer and one PerkinElmer Spectrum 3 FTIR Spectrometer, including specialized instrument modifications: the Upward Mid Sphere with compatible Integrat IR Wide-Band MCT detector, 150mm Integrating sphere, TAMS (Total Absolute Measurement System) system, and TAMS enhanced detector. These items are replacements for end-of-life equipment essential to the material characterization mission for Code 617. The OEM is PerkinElmer U.S. LLC, located at 710 Bridgeport Avenue, Shelton, CT 06484. Market research was conducted by Michael Legg (855-726-9377; michael.legg@perkinelmer.com) through direct OEM contact. The restriction is justified on three bases: restrictive proprietary rights with existing software, exclusive licensing agreements as PerkinElmer is the sole OEM (though authorized resellers exist), and direct replacement necessity. The justification emphasizes that specialized, custom modifications are proprietary to PerkinElmer; newly generated data must remain compatible with over a decade of historical baseline data to prevent costly re-baselining; existing personnel training on PerkinElmer software ensures operational continuity; and alternative manufacturers cannot integrate these modifications. The memorandum was approved by Code 02 Contracting Officer DUHAIME.KRISTEN on September 2, 2026.

Direct Replacement. The product or service is a direct replacement for parts and components for existing equipment.
☐ Other Reasons.
C. Market Research Conducted & Conclusions.
Detailed market research is required to establish why only one source, or one brand can meet the requirement for the exclusion of other sources or brands.
Restrictive Rights: PerkinElmer using existing proprietary software
Exclusive Licensing Agreements: PerkinElmer is the Original Equipment Manufacturer (OEM) of the required equipment. PerkinElmer does have a network of authorized resellers.
Direct Replacement: The exact or newer replacement products, the Lambda 1050, provides the same measurement capabilities on the same software basis that Code 617 personnel are already trained on, and provides compatible data to data historically taken by the technical group. Procuring PerkinElmer equipment to guarantee direct data compatibility with historical research, ensure operational continuity using existing proprietary software, and secure authorized OEM servicing and warranty support. UV WINLAB color software is required for the Lambda 1050.
The procurement of the brand-name PerkinElmer Lambda 1050+ Spectrometer and Spectrum 3 FTIR Spectrometer is required due to the following critical technical, physical, and integration requirements:
Essential Instrument Modifications: The material characterization mission requires highly specialized, custom-engineered modifications that are only manufactured by and compatible with PerkinElmer spectrometers. Specifically, the spectrometers must be equipped with the Upward Mid Sphere, the 150mm Integrating sphere, and the TAMS (Total Absolute Measurement System) system and TAMS enhanced detector. These specific modifications are proprietary to PerkinElmer and cannot be integrated with or operated on spectrometers from other manufacturers. Without these exact modifications, the spectrometers will not be physically or optically capable of performing the specialized measurements they are being purchased for.
Data Integrity & Historical Compatibility: NSWCCD Code 617 has an ongoing mission requirement where all newly generated measurement data must be directly comparable with over a decade of historical baseline data. This historical data was generated using PerkinElmer spectrometers.
Introducing a spectrometer from a different manufacturer would utilize different optical pathways, detection systems, and proprietary measurement algorithms, introducing unacceptable measurement variances. This would invalidate historical comparisons and require an extremely costly and time-consuming re-baselining of all material characterization standards.
