About this file
This document is a Brand-Name Justification for a U.S. Immigration and Customs Enforcement (ICE) delivery order under the NASA SEWP V IDIQ contract. ICE/ERO requires network switches and wireless access point products with specific technological capabilities, including a Center Management application for centralized network device management, Digital Network Architecture for automation and security, an Identity Services Engine for access control, power stacking capabilities, and Overlay Management Protocol (OMP) connectivity. The procurement is for a firm-fixed price delivery order within the HUBZone socio-economic category, with a 90-day performance period.
The justification details that after market research, ICE determined no other vendor products could provide all required features. Juniper's switches and wireless access point products were evaluated but deemed insufficient, as they lack a comprehensive Center Management Platform and stacking capabilities critical to ICE's network infrastructure. The Contracting Officer has determined the anticipated price will be fair and reasonable, with an expectation of receiving at least two quotes from authorized resellers. The total dollar value is redacted, but the document indicates that if it exceeds $30,000, the justification will be provided to all NASA SEWP V IDIQ contract awardees in the HUBZone socio-economic category.

1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ) proposes to award an IDIQ delivery order on behalf of the Office of the Chief Information Officer (OCIO), for its Homeland Security Investigations (HSI) office, resulting from a solicitation containing a brand-name specification.
2. Nature and/or description of the action being approved.
(a) Name of the ICE, DHS, or Multiple-Agency Multiple Award Contract that the delivery/task order or modification is being placed under:
NASA SEWP V
(b) If applicable, identify the functional category, size category, or other sub-section of awardees which will be provided with a fair opportunity to be considered:
HUBZone Socio-economic category
(c) Identify contract type and whether new action or modification:

3. Description of Supplies/Services.
(a) ICE/ERO has a requirement to procure switches and wireless access point products.
These switches and wireless access point products possess a unique Center Management application feature that provides centralized network device management, network automation, and user and device provisioning and configuration of connected network products.
Secondly, these switches and wireless access point products include the use of a Digital Network Architecture to allows for automation, security, and predictive monitoring.
Thirdly, these switches and wireless access point products include an Identity Services Engine for secure access control and segmentation.
Fourthly, these switches and wireless access point products include a power stacking capability of networked physical devices into a single logical management entity via Data Stacking to ensure cost-effective power redundancy termination of connected devices.

Lastly, these switches and wireless access point products offer an Overlay Management Protocol (OMP) connectivity feature through a compatible software defined Wide Area Network (SD- WAN) control panel. Having and utilizing all these above features is critical to the overall ICE network performance and security posture.
(b) The period of performance/delivery date will consist of 90 days after receipt of delivery order award.

4. Statutory Exception and Rationale.
Exception:
The specific exception for providing for brand-name awards under multiple award contracts is Federal Acquisition Regulation (FAR) Subpart 16.505(a)(4). An item peculiar to one manufacturer can be a particular brand-name, product, or a feature of a product peculiar to one manufacturer.
A brand name item, even if available on more than one contract, is an item peculiar to one manufacturer.
Rationale:
(a) ICE/OPLA conducted market research in July 2024, by utilizing online Internet research and e-mail correspondence. Research was conducted to determine which vendor products could provide ICE’s requirement. During this research phase, competitor’s products capabilities were assessed, namely Juniper’s EX4300 switches and Juniper’s Mist AP43 wireless access point products. These products were evaluated by the ICE/OPLA Team in terms of their capabilities and features to assess functionality within the ICE Information Technology infrastructure environment. It was determined that there were no other vendor’s switches and wireless access point products outside of the xxxxx xxxxxxxxxx switches and xxxxxxxxxxxxxxxxxx wireless access point products that can provide all the necessary features required by ICE.
(b) Juniper’s EX4300 switches and Juniper’s Mist AP43 wireless access point products meet some of ICE’s features required but do not have the ability to provide a Center Management Platform application. This Center Management Platform is necessary to ICE as it provides a centralized network management, automation, assurance, and analytics. Without the centralized management platform ICE would be required to manually configure every switch and WAN, implementing changes or deploying updates across the network would require significant time and coordination, limiting visibility on traffic flows and device performance.
The Juniper devices also lack stacking capabilities. Stacking capabilities such as Cisco’s Stack Wise & Stack Power give ICE the ability to possess multiple Catalyst switches to operate as one logical switch with a single control and management plane. Without the stacking features ICE would not be able to maintain a unified management, and each switch would have to be configured, updated, and management individually. All of the listed functionality is a critical ICE requirement that is needed to support end users and mission essential applications to work properly in the field. Xxxxxxxxxx xxxx xxxxxxxxxx switches and xxxxxxxxxxxxxx wireless access point products have these modular

functions built into their products.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on adequate price competition. Multiple NASA SEWP V Contract Holders under the HUBZone socio-economic category provide these brand name xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx wireless access point products. The Government has a reasonable expectation that at least two quotes will be received.
6. Any other facts supporting the justification.
None
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
It is not likely that ICE/ERO’s infrastructure will change before this delivery order ends. However, to increase competition, OAQ will seek and solicit as many authorized resellers of xxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxx xxxx switches and xxxxxxxxxxxxxxxxxxxxx wireless access point products as possible.
8. If the total dollar value of this action exceeds $30,000.00, OAQ intends to provide the justification and supporting documentation along with the solicitation to all (IDIQ) contract awardees under the NASA SEWP V IDIQ HUBZone socio-category in accordance with FAR 16.505(a)(4)(iii)(A).
