About this file
This is a Brand Name Justification Memorandum for a firm fixed price purchase order issued by the Naval Surface Warfare Center Panama City Division (NSWC PCD), located at 110 Vernon Avenue, Panama City, FL 32407-7001.
The procurement requires three line items totaling 60 units of Milpower Source Inc. products: 20 units of M919 9-Ports Gigabit Ethernet SwitchOn Board with Setup (part number I-919-00), 20 units of M919-900 Evaluation Board with Setup (part number I-919EV-000), and 20 units of M919-50 Cooling Plate Kit for MILTECH 919 (part number I-CP919-00). The total estimated contract value exceeds micro-purchase levels but does not exceed the simplified acquisition threshold of $350,000.00. The acquisition will be conducted using simplified acquisition procedures and represents a firm fixed price award to authorized sellers of Milpower Source Inc.
The justification for restricting competition to a single brand is based on the items being part of a configuration-controlled system requiring certification and drawing updates if alternative brands were selected. The Government determined that awarding to Milpower Source Inc. represents the best value and lowest overall cost alternative, considering technical, price, and past performance factors. No significant cost savings are anticipated through purchasing alternate brands. Market research was not conducted based on the determination that Milpower Source Inc. is the only brand capable of meeting the Government's needs without incurring substantial delays and costs associated with system recertification.

Text version
The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item(s) listed in Paragraph 3 of this document. The items specified in this procurement are part of a configuration-controlled system. As such, no other brand can be used.
If another brand were selected, the system would be required to go through certification and drawings would have to be updated. This would result in significant delay and cost to the
Government.
As such, the government does not expect significant savings through purchasing alternate brands, and it is more advantageous to the Government to award on a brand name basis to authorized sellers of the MILPOWER SOURCE INC for the item(s) listed in Paragraph 3 of this document.
5. A determination by the ordering activity contracting officer that the order will represent the best value consistent with FAR 12.203.
Prior to award, the Contracting Officer shall determine that the resulting order represents the best value and results in the lowest overall cost alternative (considering technical, price, and past performance) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Milpower Source Inc. is the only brand that can meet the Government’s needs.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Milpower Source Inc. is the only product that can meet the requirement.
