About this file

This is a Brand Name Memorandum justifying a limited source acquisition for software licensing.

The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) in Panama City, Florida, is acquiring Siemens NX Design Software for Industrial Design on an XaaS (Software-as-a-Service) basis for nine months. The acquisition will be conducted as a firm fixed price purchase order using simplified acquisition procedures with a total value not exceeding $350,000. The contract will be awarded to an authorized reseller of Siemens software products, with delivery required no later than 30 days after award.

The justification for the brand name restriction is based on the MCM USV (Mine Countermeasures Unmanned Surface Vessel) program's technical requirement for Siemens NX Design for Industrial Design, along with Creo Design Advanced Plus and Zuken software, to support engineering design and technical data package development. The software is essential for creating, modifying, and managing native models, drawings, schematics, and engineering data supporting RDT&E efforts and configuration management. The Contracting Officer has determined this acquisition represents the best value and lowest overall cost alternative. The justification cites schedule risk, cyber vulnerability concerns, and potential loss of the system's Authority to Operate (ATO) if engineering updates and configuration management activities are delayed, making urgent acquisition of the software critical to Navy MCM operations.

Subj: BRAND NAME MEMORANDUM TO ACQUIRE SIEMENS NX DESIGN SOFTWARE AND

SOFTWARE MAINTENANCE

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare

Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts

Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a brand name basis, to acquire NX Design Software.

Siemens NX (now part of the Designcenter suite) is an advanced, high-end engineering software used for 3D modeling, simulation (CAE), and manufacturing (CAM). The software is integral to the build, test, and program complex products. Competition will be limited to authorize resellers of Siemens software products.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The contract effort is to acquire:

Description Part Number Qty Unit Price Total Price

NX Design for Industrial Design (XaaS) (9 months) NX93300-Sub 2

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. All software will be delivered no later thirty (30) days after award of the order.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. Authority: FAR 6.103-1(d), Application for brand-name descriptions.

Siemens NX Design software is the only brand of software that will meet the Government’s needs for the following reasons. The MCM USV program requires Siemens NX Design for Industrial Design, Creo Design Advanced Plus, and Zuken software licenses to support engineering design and technical data package (TDP) development activities.

The software is necessary for the creation, modification, and management of native models, drawings, schematics, and associated engineering data supporting ongoing RDT&E efforts. This capability is required to maintain engineering continuity, configuration management, and production support within the approved MCM USV ATO boundary. Without this software capability, the MCM USV program will be unable to generate, revise, and manage required engineering models and technical data packages. This would delay engineering updates, configuration management actions, and production support activities, resulting in schedule risk and potential impact to program execution. Failure to complete these updates would cause cyber vulnerabilities within the MCM USV system. This would cause the MCM USV to lose its authority to operate (ATO) which would be devastating to the US Navy
