About this file

This is a Brand Name Justification memorandum for a firm fixed price contract to procure diving equipment for the Naval Surface Warfare Center Panama City Division (NSWC PCD), Code 024, located at 110 Vernon Ave., Panama City, FL 32407. The memorandum, dated January 15, 2026, authorizes the acquisition of Sherwood Scuba Group diving regulators and service kits under simplified acquisition procedures with a total estimated value less than $35,000, funded through FY25 RDT&E funding. The specific items required are five SH Blizzard Pro Yoke Regulators (part number SRB9975), five SH Blizzard Pro DIN Regulators (part number SRB9975D), and five Blizzard Pro/Oasis Pro Service Kits (part number 9950-PK).

The justification for brand-name restriction is based on NSWC PCD's taskings by 00C3 to perform an Analysis of Alternatives for open circuit regulators supporting fleet diving through the Authorized for Navy Use program. A Request for Information (RFI N61331-25-SN-Q37) was issued and analyzed; while several responses were deemed possible solutions, Sherwood Scuba Group is identified as the only brand meeting the government's needs. The memorandum asserts that competition would not yield significant savings and would cause significant and unacceptable delays negatively impacting the requirement. The Contracting Officer determined the acquisition represents best value and the lowest overall cost alternative. The acquisition will not be synopsized on sam.gov due to the estimated value being below $35,000. Approval signatures are required from the Requesting Official (Ryan Fisher) and the Contracting Officer (Nicole Stevens, Jamell Kilgore, or Kaitlin Summerville).

MEMORANDUM

From: Ryan Fisher, NSWC PCD

To: Nicole Stevens, NSWC PCD Code 024

Subj: BRAND NAME JUSTIFICATION TO PROCURE DIVING EQUIPMENT (Purchase

Request 1301306455)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”

This is a brand name justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon

Ave., Panama City, FL, 32407.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price contract for the Sherwood Scuba Group items listed in

Paragraph 3 of this document.

3. A description of the supplies or services required to meet the agency’s needs

(including the estimated).

Line Part # Description Qty.

1 SRB9975 SH BLIZZARD PRO YOKE REGULATOR 5

2 SRB9975D SH BLIZZARD PRO DIN REGULATOR 5

3 9950-PK BLIZZARD PRO/OASIS PRO SERVICE KIT 5

This acquisition will be conducted using simplified acquisition procedures with a total estimated value less than $35,000. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. The contract action will be funded through FY25 RDT&E funding.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item(s) listed in Paragraph 3 of this document. NSWC PCD has been tasked by 00C3 with performing an Analysis of Alternatives for open circuit regulators to support fleet diving through the Authorized for Navy Use (ANU). A Request For Information (RFI N61331-

25-SN-Q37) was issued and several responses were received. The submissions were analyzed and several of the responses have been deemed as possible solution, including this submission from Sherwood Scuba Group included. Purchase requests are being issued for further analysis and testing of hardware to those companies whose hardware appears to meet the minimum criteria. The regulators need to be purchased, in order to continue the effort.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the Sherwood Scuba Group brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Sherwood Scuba Group is the only brand that can meet the Government’s needs. This requirement will not be synopsized in the government point of entry sam.gov because it is estimated less than $35,000.00.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Sherwood Scuba Group is the only brand that can meet this requirement.
