About this file
This is a Brand Name Justification Memorandum from the Naval Sea Systems Command (NSWC) Panama City Division for purchasing Zarges aluminum storage cases. The document justifies a firm fixed-price order for 10 Custom Foam, Ethafoam 4101 FR Zarges Custom K470 Case Design units at $1,123.21 each, totaling $11,232.10. The purchase will be funded by Navy Working Capital Funds and conducted using simplified acquisition procedures below the $350,000 threshold.
The justification emphasizes that Zarges is the only acceptable brand, as it is the Original Equipment Manufacturer (OEM) of the K470 case and the approved storage container for USSOCOM PEO-M Combat Diving. The document argues that Zarges is the sole supplier that meets the military operators' technical requirements, and therefore competition is not expected to yield significant savings. The Contracting Officer has determined that the Zarges cases represent the best value for the Government's needs.

This action will award a firm fixed price order on a brand name specific basis to the lowest price offeror that is an authorized reseller of Zarges brand products.
3. A description of the supplies or services required to meet the agency’s needs
(including the estimated value).

Total: $11,232.10
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold of
$350,000.00. This contract action will be funded with Navy Working Capital Funds (NWCF).
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible
Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR
6.302-1(a)(2)(iii)(C).
Pursuant to FAR 6.302-1(a)(2)(iii(C), Zarges is the only brand of equipment that will meet the
Government’s needs for the following reasons. Zarges is the Original Equipment Manufacturer
(OEM) of the K470 case and is the only one demonstrated to meet the requirements of the sponsoring program office, USSOCOM PEO-M Combat Diving. The Zarges case is the approved storage container for use by the USSOCOM military operators and as such, it has undergone rigorous testing to demonstrate it meets the technical capability requirements of its operators. Other brands have not been demonstrated to properly interface and meet the technical requirements of the USSCOM military operators and sponsoring program office.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Government’s best interest to acquire Zarges cases.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The purchase amount is less than $25,000 and will not be synopsized on the Contract
Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Zarges to provide the products.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Zarges is the only brand that can meet this requirement.
