About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) for a lease extension of structured parking spaces in New York, NY.
The General Services Administration seeks to extend the current lease for 82 structured parking spaces located near FBI offices in New York, NY (Lease Number LNY00603) for 36 months commencing August 1, 2026. The FBI previously occupied 125 surface parking spaces but reduced the requirement to 82 spaces following relocation of 43 vehicles to a federally owned parking garage at 26 Federal Plaza. The parking location is critical to FBI operations due to its proximity to two federal buildings (26 Federal Plaza and 290 Broadway) and the agency's mission requirement for self-parking capability. The estimated total contract value is $1,547,832.00, with annual costs of $500,856 (year 1 at $509 per space), $515,616 (year 2 at $524 per space), and $531,360 (year 3 at $540 per space), reflecting a 3% annual increase. Market research conducted June 22, 2026, confirmed these rates are fair and reasonable within current market range. The justification cites 41 U.S.C. 3304(a)(1) and GSAR 570.405 as authority for sole-source extension, specifically based on documented organizational uncertainties regarding the agency's long-term parking needs and potential future relocation to federally controlled space. The contracting officer certified the extension as in the government's best interest to avoid operational disruption while awaiting clarification of the FBI's long-term parking requirements or availability of federal space.

Justification for Other Than Full and Open Competition, Extension NOTE: THIS TEMPLATE REFLECTS WORDING AND CITATIONS FOR LEASE EXTENSION ACTIONS BELOW PROSPECTUS. LEASE EXTENSION JUSTIFICATIONS BASED ON MISSION OR LACK OF ALTERNATIVE ACCEPTABLE LOCATIONS MUST USE DIFFERENT WORDING, AS APPLICABLE FOR THE CIRCUMSTANCES.
U.S. General Services Administration PBS, Office of Leasing
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
| PROJECT NUMBER: | 5NY0704 |
| Agency Name: | JD FBI |
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The General Services Administration currently leases 82 structured parking spaces at REDACTED New York, NY under lease number LNY00603 for the Federal Bureau of Investigation. The current lease expires July 31, 2026. Approval is requested to negotiate a lease extension with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing a lease extension are detailed in GSAR 570.405: Lease extensions.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING ESTIMATED VALUE).
The Government requires an extension of the current lease for 36 months to commence on August 1, 2026. The agency previously occupied a total of 125 surface self-parking spaces, however, prior to expiration the required number of spaces was reduced to 82 spaces when the FBI relocated 43 vehicles to the nearby parking garage located at 26 Federal Plaza, New York, NY. The parking extension will allow the agency to maintain secured parking for the remaining 82 vehicles that could not be accommodated at the federally owned parking garage.
The FBI has not provided GSA with its long-term parking needs currently. GSA will consider housing the parking need within a federally controlled facility should additional spaces become available. The location of the parking lot is near FBI’s offices located at two federal buildings. In addition, the ability to self-park the Government vehicles is critical to FBI's mission requirements.
This extension is required to protect the agency’s parking needs until such time that parking requirements are provided or federal space becomes available. Considering the dearth availability of self-parking spaces within the delineated area and the current average parking rental rate for self-parking locations, we expect the cost of this extension will increase for the 36-month lease period. The estimated cost of this lease extension is $509 per space or $500,856 annually for year 1, $524 per space or $515,616 annually for year 2, and $540 per space or $531,360 annually for a total contract value $1,547,832.00
3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through: FAR 6.103-1 (GSA RFO-2025-06) and GSAR 570.405. In accordance with GSAR 570.405, use of the sole source authority is appropriate when the Government experiences a delay in acquiring replacement space in situations such as, but not limited to, the following:
| |_| | The agency occupying the leased space is scheduled to move into another Federally controlled space, but encounters unexpected delays in preparing the new space for occupancy |
| |_| | The government encounters unexpected delays outside of its control in acquiring replacement space |
| |_| | The government is consolidating various agencies, and the contracting officer needs to extend the terms of some leases to establish a common expiration date |
| |X| | The agency occupying the space has encountered delays in planning for a potential relocation to other federally controlled space due to documented organizational, financial, or other uncertainties |
| 4. | DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. |
It is in the best interest of the Government to remain at the current location during the extension period. The FBI occupies space in both 26 Federal Plaza New York, NY and 290 Broadway New York, NY. Both federal buildings are located approximately 2 blocks from the current parking leased location. The car park located at REDACTED is supporting the agency's mission by being located in such close proximity to FBI’s offices.
5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE.
In accordance with GSAR 570.106(d) and 570.405, an advertisement is not required for extensions.
6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
Recent market research conducted by the Lease Contracting Officer in New York, NY showed the monthly parking rates to start at REDACTED Therefore, the anticipated rental rates for this lease extension of $509 per space with a 3% increase annually, are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.
7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.
On June 22, 2026, market research was conducted using REDACTED. The market research showed the monthly parking rates started at REDACTED.
8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
Remaining at the current location under a 36 month extension avoids a holdover and allows the Government to continue operations without disruption.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION.
N/A
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, GSA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo competitive action.
Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.
11. CONTRACTING OFFICER CERTIFICATION.
By signature on this Justification for Other than Full and Open Competition, the GSA Lease Contracting Officer certifies that the award of a lease extension of 36 months for LNY00603 is in the Government’s best interest and that this Justification is accurate and complete to the best of the GSA Lease Contracting Officer’s knowledge and belief.
