Contracting Activity: Internal Revenue Service, Office of Procurement, Office of Information Technology Acquisition Program Services Branch

2.a Nature and/or description of the action being approved:

The purpose of this Justification for an Exception to Fair Opportunity is to obtain approval to award a hybrid contract with CGI Federal to provide IT support service for the TIO applications described in section 3.a below. The period of performance will be for a base period of 8/16/20-11/15/20 and an option period of 11/16/20-2/15/21.

3.a A description of the supplies or services required to meet the agency’s needs:

The proposed acquisition is to acquire the following IT support services for TIO AI Application Platform Support (APS) Section, in five key functional areas:

Maintenance: Schedules and coordinates all Affordable Care Act (ACA) project maintenance activities throughout the year, including communication and coordination with MeF and CMS during high-risk periods.

APS Strategic Infrastructure Initiatives: Support critical AD-wide upgrades Java Enterprise Upgrade, .Net Enterprise Upgrade, SQUA to CMPlus, and Infrastructure Currency Filing Season 2021.

APS Environments: Responsible for maintaining the Environment Integrated Master Schedule that tracks upgrades, UWRs, CRs, and scheduled patching events.

Process Improvement: Creates efficiencies through process improvement, automation, and data-driven analytics. This includes the design and execution of TIO’s Certificate Management Initiative, focused on mitigating the risk of outages due to certificate failures, since its inception in 2018.

Executive Support: Provide myriad tasks and support, including action item tracking and resolution, data call management and consolidation, risk and issues management, tracking, and reporting, meeting scheduling and facilitation, planning quarterly strategic offsite meetings and CMS/IRS summits, daily stand-up briefings, and SharePoint document maintenance.

CMS Support: Recording, assigning, tracking, and reporting CMS/IRS action items.

4.a Identification of the exception to fair opportunity being used:

☐ FAR 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

☒ FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

☐ FAR 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order ☐ FAR 16.505(b)(2)(i)(D) – It is necessary to place an order to satisfy a minimum guarantee.

☐ FAR 16.505(b)(2)(i)(E) – For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

4.b Supporting rationale:

CGI Federal is the incumbent and this requirement is currently being re-competed via RFQ 8066 via GSA Alliant 2. RFQ 8066 consolidated multiple orders and in order to allow time for the competition a sole source bridge order is necessary. This will allow time for a transition in addition to continued service

CGI has provided maintenance support to ACA releases since 2014. The team schedules and coordinates all Affordable Care Act (ACA) project maintenance activities throughout the year, including communication and coordination with MeF and CMS during high-risk periods. The CGI team identify the upstream and downstream impacts of any production activity and communicate and plan, accordingly, thus preventing system failures or P1 issues.

CGI also supports critical AD-wide upgrades Java Enterprise Upgrade, .Net Enterprise Upgrade, SQUA to CMPlus, and Infrastructure Currency Filing Season 2021. In addition, CGI is responsible for maintaining the Environment Integrated Master Schedule that tracks upgrades, UWRs, CRs, and scheduled patching events. No other vendor is capable of providing this support on a temporary basis until the above RFQ is awarded and transition occurs to mitigate unacceptable technical risks.

5. A determination that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on comparing prices/costs and labor hours with prior and similar task orders issued and by performing cost and price analysis techniques in accordance with FAR Subpart 15.404.

As stated in section 4b this requirement is part of a consolidated re-compete, which is currently posted on GSA Alliant 2 and is anticipated to be awarded in November 2020.
