The J&A justifies sole source procurement based on Amherst Systems' proprietary ownership of the JTE RFGU circuit cards and the complex, proprietary technologies required for repair. Market research, including a Sources Sought synopsis posted on 17 November 2025 (closed 2 December 2025), yielded only one response from BHPE, which lacked necessary skills, experience, acceptance test procedures, and access to proprietary data. The Government determined that reverse engineering the circuit cards would be cost-prohibitive with an unacceptable return on investment and substantial delays. The J&A confirms that fair and reasonable pricing will be determined through analysis of the offeror's proposal, technical analysis, independent Government cost estimate, and historical pricing. The contract will use 4930-CSAGS Working Capital funds, and no separately priced CLINs for intellectual property or IP rights are included, with administrative CDRLs covering CAWF, RIB, and CPP deliverables.
