AUTHORITY: FAR 6.302, 41 U.S.C. 253(c)
Solicitation #140D7019R0007
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR 6.3 and in accordance with the requirements by FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition for the Department of the Interior, Interior Business Center (IBC), Acquisition Services Directorate (AQD), Division IV (D4), in support of the Department of Homeland Security (DHS), Science and Technology Directorate (S&T), Office of National Laboratories (ONL), Plum Island Animal Disease Center (PIADC).
2. Nature and/or description of the action being approved.
DHS S&T PIADC has a need to award a Small Business Innovative Research (SBIR) Phase III contract to Red Balloon Security (RBS) to upgrade and expand the existing PIADC Building Management System (BMS) production and test & development (T&D) environments, upgrade Siemens existing panels and add new Siemens panels with RBS’ Symbiote Defense technology. This technology was developed under SBIR Phase II contract D15PC0113. This SBIR Phase III contract award is derived from, extends, or completes efforts made under the prior SBIR Phase II funding agreement and is authorized pursuant to 15 U.S.C. 638(r)(4). This award is for a one-year base period of performance. The resulting contract will be funded using Research, Development Acquisition and Operations (RDAO) five (5) year funds.
This contract will be awarded to:
Red Balloon Security 336 W. 37th St Ste 1024 New York, NY 10018-4592
DUNS: 078682097
CAGE: 6TM83
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
RBS will provide to the Federal Government the Symbiote Defense technology developed through SBIR Phase I and Phase II awards performed through multiple agencies. This contract action will upgrade and expand the existing PIADC BMS, production and test & development (T&D) environments, as necessary to enhance system cyber security through the injection of Symbiote Defense technology and to extend monitoring capability to high priority areas within Bldg. 101 in order to monitor and detect potential abnormal conditions in biocontainment airflow.
Enhancements installed as part of this effort will minimize the potential for or prevents the release or transfer of airborne biological agents outside of containment. Priority will be given to rooms, spaces and areas where the risk of airborne release is highest while also considering the utilization needs of the research staff.
The total estimated value inclusive of all options is $1,346,519.46. This action will not include FAR 52.217-8, Option to Extend Services.
4. An Identification of the statutory authority permitting other than full and open competition.
FAR 6.302-5 -- Authorized or Required by Statute. 41 U.S.C. 3304(a)(5)
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
This SBIR Phase III contract to RBS is derived from, extends, or completes efforts made under SBIR Phase II contract D15PC0113 and is authorized pursuant to 15 U.S.C. 638(r)(4).
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
SBIR Phase III contracts are exempt from FAR Subpart 5.2 based on the SBIR Phase I award being in accordance with FAR 5.202(a)(7) The proposed contract action results from acceptance of a proposal under the Small Business Innovation Development Act of 1982 (Pub. L. 97-219)
7. A determination by the contracting officer that the anticipated cost to the
Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on a comparison to current market rates for the same or similar work.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
