About this file

This is a professional services determination letter issued by Travis Dutton-Leyda, Chief Procurement Officer for the City of Santa Fe, in coordination with the Central Purchasing Division (CPD) and the Office of Affordable Housing (OAH) regarding the FY27 Affordable Housing Trust Fund (AHTF) Request for Proposals. The procurement seeks qualified organizations to deliver eligible affordable housing units through a competitive sealed proposal process. The scope of work encompasses housing-related activities including development, rehabilitation, acquisition, construction, renovation, conversion, financing, and ownership of affordable housing units and supporting infrastructure. Priority consideration is given to proposals advancing for-sale affordable housing such as single-family homes, condominiums, townhomes, duplexes, triplexes, and rental accessory dwelling units that expand long-term affordability and neighborhood stability. The determination classifies the scope of work as Professional Services and applies solely to this classification without assessing compliance with all applicable legal standards. The procurement must adhere to City of Santa Fe Central Purchasing policies, the Procurement Manual, and all relevant state statutes.

The determination establishes procedural requirements for processing the procurement through the Munis system and OpenGov platform, with specific procurement thresholds dictating competitive requirements. Procurement amounts under $20,000 annually require one quote; amounts between $20,000 and $60,000 require three quotes unless utilizing cooperative or existing contracts; amounts of $60,000 or greater require an RFP per NMSA 1978, Section 13-1-117.1. The City identifies funding through the Affordable Housing Trust Fund as codified in Santa Fe City Code Section 26-3, with the primary purpose of increasing and preserving affordable housing for low- and moderate-income residents. Department-specific pre-approvals and signatures are required from multiple City divisions including Treasury, IT, Vehicles, Grants, Construction/Facilities, Emergency Management, and Accounts Payable depending on project components. The determination reserves the right to revise should the scope of work change from original submission and directs the requesting office to save the determination as a PDF and upload it to corresponding Munis records.

If you are processing a procurement where the forecasted amount is =/> $60k, per NMSA 1978, Section 13-1-117.1, if you aren’t using a cooperative or existing contract, you must process an RFP.

< $20k per year, one quote is acceptable.

From $20k to $60k per year, if you aren’t using a cooperative or existing contract, you must provide 3 quotes in your req. Must use the Munis Bid Module, OpenGov, or Pavilion.

Identify your funding source and notify Purchasing.

It's essential to determine the funding source early, as it impacts the required documentation and contract language. For example, if federal funds are being used, specific federal provisions must be included in both the procurement request and the resulting contract.

Notifying Purchasing of the funding source upfront ensures compliance and avoids delays.

Follow the link below to review existing price agreements, contracts, or cooperative agreements that might be applicable to this request. You might be able to use an existing price agreement/contract to save time and money.

From: LOVATO, JOANN D. <jdlovato@santafenm.gov> Sent: Thursday, February 26, 2026 11:12 AM To: DUTTON-LEYDA, TRAVIS K. <tkduttonleyda@santafenm.gov> Cc: CHAVEZ, FAVIOLA A. <fachavez@santafenm.gov> Subject: Determination of Services for AHTF

Hi Travis, Below is language for the AHTF RFP that encompasses the overall eligible activities that will be in the SOW for the awarded contracts dependent on which project(s) the Offeror submits a proposal for.

Please provide an official determination of services for the procurement file.

Thank you.

The City of Santa Fe’s OAH seeks to identify and contract with qualified organizations capable of delivering eligible affordable housing units as outlined under the AHTF.

This procurement will result in formal contracts between the City and selected Offerors/Applicants. These contracts may support a range of housing-related activities— including development, rehabilitation and acquisition —provided they meet program guidelines and demonstrate alignment with the Affordable Housing Act and City housing priorities.

The purpose of this Request for Proposals (RFP) issued by the Central Purchasing Division (CPD) in coordination with the Office of Affordable Housing (OAH) is to solicit sealed proposals through a competitive process to establish contracts for projects that advance affordable housing in the City of Santa Fe. This RFP is focused on supporting eligible costs associated with the acquisition, development, construction, renovation, conversion, financing, or ownership of affordable housing—or related supporting infrastructure.

All proposed projects must align with the community’s established affordable housing goals and priorities, as defined under the Affordable Housing Trust Fund (AHTF) and related City plans and policies. As codified in Santa Fe City Code (SFCC) 26-3, the primary purpose of the AHTF is to increase and preserve the supply of affordable housing for low- and moderate-income residents in the City of Santa Fe.

Housing Development and Preservation (Infrastructure-Focused) The AHTF supports projects that involve the creation, rehabilitation, or preservation of affordable housing units, including associated infrastructure necessary to support housing development.

The City will give preference to proposals that advance the development of for-sale affordable housing to include but not limited to single-family homes, condominiums, townhomes, duplex, triplex or rental of developed Accessory Dwelling Units (ADU) that expands long-term affordability and supports neighborhood stability.

Priority consideration will be given to development teams that demonstrate the ability to:

Deliver high-quality affordable to low- and moderate-income households Provide a mix of affordability levels that serve workforce and entry-level homebuyers Incorporate long-term affordability mechanisms such as:

Deed restrictions Ground lease structures Shared equity approaches

Resultant projects shall:

Include innovative resident engagement models that enhance onsite safety and community stability, including voluntary residency by qualified public safety personnel in exchange for defined community participation activities, consistent with all applicable fair housing and funding requirements Maximize the number of affordable units delivered per site Support pathways to homeownership for income-qualified households Utilize cost-effective design and construction methods to improve attainability Include infrastructure and site improvements within the development scope Align affordability periods with long-term community housing goals
