FDA receives this support under contract HHSF223201400016B with Open Technology Group, which expires on March 28, 2020. With the expiration of this contract, FDA will be at risk of losing the above-mentioned support for the Agency.

4. The authority and supporting rationale (see FAR 8.405-6(a)(1)(i); (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

a. Acquisition authority.

☐ This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with Federal Acquisition Regulation (FAR) 8.405-6(a), consideration of schedule contractors will be restricted to fewer than the number required at FAR 8.405-1, FAR 8.405-2, FAR 8.405-3 (i.e., fewer than three FSS contractors). FAR 8.405-6 (a)(1)(i), for a proposed order or BPA with an estimated value exceeding the micro-purchase threshold not placed or established in accordance with the procedures in FAR 8.405-1, FAR 8.405-2, or FAR 8.405-3, the only circumstances that may justify the actions are-

☒ (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

☐ (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

☒ (C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. ☐ This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with FAR 8.405-6(b), consideration of schedule contractors will be restricted only to the item peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

b. Demonstration of the proposed contractor(s) unique qualifications to provide the required supply or service.

• Name and address of the proposed contractor(s).

Open Technology Group, Inc

13800 Coppermine Road

1st, 2nd, & 3rd floors

Herndon, VA 20171

(301) 588-1600

• Nature of the acquisition and proposed contractor(s) unique qualifications.

The RDC warehouse and personal computer (PC) installation support function is critical to agency operations, and FDA cannot fulfill its mission in the absence of these services. Providing for fair opportunity would cause an unacceptable delay and result in serious injury to the Government.

• A short-term bridge contract with a three-month period of performance with one-month options, not to exceed six months, will permit FDA to provide for continuation of mission-critical services until a new competitive BPA can be award for a continuation of services. • FDA does not have full time employees on staff that can provide the support in absence of contractor support services.

• A lapse in RDC warehouse support would prevent FDA from receiving, managing, deploying, and the delivery of IT equipment. This would result in Accountable Property not properly being received, the transfer of IT Equipment between FDA/OIMT and FDA Centers, image support and Center top off support, and the delivery of Center requests of IT Equipment. • A lapse in PC installation support would prevent FDA from properly handling New Hire installations. This would result in a new hire employee onboarding without a proper workstation to perform their daily duties.

• A lapse in PC installation support would prevent FDA from properly handling PC Refresh installations. This would result in employees using computers out of warranty without support if the PC experienced issues and needed to be replaced. • A lapse in RDC support would prevent FDA from handling and processing surplus IT equipment of Accountable and Non-Accountable Personal Property.

5. Determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The FDA will perform price analysis. FDA has access to competitively priced labor rates and projected levels of effort for identical work that it receives under the current contract. Additionally, FDA has historical data to support pricing for RDC warehouse and installation support services. FDA will ensure that the proposed pricing for the bridge contract represents a fair and reasonable price.

(a) GSA has already determined the prices of the supplies and services under FSS contracts, including rates for services offered at fixed hourly rates, to be fair and reasonable; and (b) by placing an order against a schedule contract using the procedures in FAR 8.405-1, the ordering activity CO has concluded that the order represents the best value (see FAR 2.101) and results in the lowest overall price alternative, the determination shall cite:

6. Description of the market research conducted among schedule holders and the results, or a statement of the reasons market research was not conducted.

Due to the nature of awarding this bridge, Market Research is not warranted as this is an urgent and compelling need and following the procedures would result in unacceptable delays. The incumbent Contractor

7. Any other facts supporting the justification.

N/A; supporting justification is outlined above.

8. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

(a) Removal of barriers to competition.

The FDA is an advocate of competition. As mentioned in sections 2 and 4b, FDA intends to pursue competitive actions to fulfill its long-term needs for RDC warehouse and installation support services. The period of performance of this bridge is limited in duration to allow enough time to conduct a competitive procurement.

(b) Listing of sources, if any, that expressed an interest, in writing, in the acquisition.

FDA issued a source sought notice (Solicitation Number FDA-RFI-1207199) that closed on February 25, 2019. (7) Seven vendors responded and out of those (7) vendors – (3) were rated highly capable

(1) was rated capable

(1) was rated marginally capable

(2) were rated not capable

Please refer to the RFI Key Capabilities Matrix for full details.
