About this file

This is a Class Justification and Approval (J&A) document for the award of a sole-source contract by the Department of the Navy, Military Sealift Command (MSC) Norfolk. The procurement authorizes a firm fixed-price purchase order to Trident Maritime Systems/Lakeshore Systems, the original equipment manufacturer (OEM), for stern ramp material required for the USNS NEWPORT (T-EPF 12) Expeditionary Fast Transport vessel. The supplies are necessary to comply with regulatory requirements established by the U.S. Navy, U.S. Coast Guard, and American Bureau of Shipping (ABS).

The justification for sole-source procurement under 10 U.S.C. 3204(a)(1) is based on the fact that Trident Maritime/Lakeshore is the only responsible source capable of providing the required parts. The stern ramp is designated as a ship-critical safety item, and the OEM holds proprietary design data, drawings, and specifications for the assembly (Model F113533). Direct replacement parts must be identical to the original components to ensure proper fit, function, and compatibility with existing systems while maintaining safety and operational certifications. MSC perpetually solicits submissions from non-OEM contractors for parts qualification through its Business Opportunities website and will post a sole-source solicitation notice at the Government Point of Entry. The Contracting Officer has determined the anticipated cost will be fair and reasonable in accordance with FAR 15.404-1(b).

J&A No. N10426Q0054

CLASS JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk

2. Description of the Action Being Approved: Award of a purchase order on a firm fixed price contract on a sole source basis to Trident Maritime Systems/Lakeshore Systems the Original Equipment Manufacturer (OEM) for the stern ramp onboard Expeditionary Fast Transport (T-EPF) Vessels. This requirement is for stern ramp material for the USNS NEWPORT (T-EPF 12).

3. Description of Supply Services: To accomplish the work items detailed in the enclosure, which are needed to comply with regulatory requirements of the U.S. Navy, U.S. Coast Guard, and American Bureau of Shipping.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 3204(a)(1) Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Authority

Trident Maritime/Lakeshore is the historical and current Original Equipment Manufacturer (OEM) for these items and is the only source capable of providing the required parts. The stern ramp is designated as a ship-critical safety item. The OEM holds the proprietary design data, drawings, and specifications for the stern ramp assembly. These parts must be sourced from the OEM to ensure they are compatible in form, fit, and function with the existing system (Model: F113533) to maintain safety and operational certifications with the American Bureau of Shipping (ABS). The required components are direct replacement parts and must be identical to the original parts to ensure proper fit, function, and safety.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: For reasons set forth in Paragraph 5, this requirement is not a candidate for full and open competition. MSC perpetually seeks submissions from non-OEM contractors for qualification of their parts and/or services as an acceptable alternative at the MSC Business Opportunities website. The Government intends to post a sole-source solicitation notice at the Government Point of Entry with the intent of awarding a firm-fixed-price purchase order to the sole source provider, Trident Maritime/Lakeshore.

7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable IAW FAR 15.404-1(b).

8. Actions to Removed Barriers to Future Competition: For the reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts for these types of supplies. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
