About this file
This is a Justification and Approval for Use of Exception to Fair Opportunity document (J&A) issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.
The procurement concerns a non-competitive Firm Fixed Price (FFP) delivery order (Order No. N5005426FL005) to be awarded to Tecnico Corporation for industrial support services on the USS FORT LAUDERDALE (LPD-28). The specific work involves the removal and reinstallation of a temporary access into Main Machinery Room Number Two to enable piping repairs, including replacement of an entire fuel header pipe on the Number 2B Main Propulsion Diesel Engine. The work is performed under Request for Contract Change (RCC) 9N and is part of the Continuous Maintenance Availability (CMAV) program under SSP TPPC-LPD28-MARMC26-S001. The contracting activity invokes the non-competitive authority under FAR 16.505(b)(2)(i)(A), citing urgent agency need that would result in unacceptable delays if full and open competition were provided. The justification emphasizes that Tecnico is the only company with the required equipment and capability to meet the immediate requirement, with market research deemed impracticable due to the critical nature of the work requiring immediate commencement. The estimated cost is determined to be fair and reasonable based on historical data, Independent Government Estimate (IGE), project manager technical knowledge, contractor's fully burdened ship repair labor rates, and material burden rates. The document includes certifications by technical/requirements personnel, legal counsel, and the Contracting Officer approving the non-competitive award.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY
IAW FAR 16.505(b)(2)(i)(A) this procurement must be issued on a non-competitive basis due to the urgency of the required support which is under the same availability currently in execution and includes the same period of performance as the awarded delivery order period of performance. This additional work must be issued under a non-competitive basis because if the Government were to provide for fair opportunity, the entire schedule would be delayed by at least 30 days causing a great impact to the overall mission critical requirement.
