About this file
This is a Justification and Approval for Use of Exception to Fair Opportunity (J&A) issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.
The procurement authorizes the addition of non-competitive work under Firm Fixed Price (FFP) Delivery Order N5005426FL001 to East Coast Repair and Fabrication for critical repairs to the USS GUNSTON HALL (LSD-44). The specific work required is repair of a Balanced Joiner Door, identified as Request for Contract Changes (RCC) RCC 77N Work Item 624-11-001. The repairs include removal of the existing joiner door, repair to the ship's bulkhead where the door is mounted, and installation of a replacement door. The statutory authority cited is FAR 16.505(b)(2)(i)(A), permitting non-competitive procurement when urgency prevents fair opportunity without causing unacceptable delays. The J&A justifies the award to East Coast Repair based on the critical nature of the work, the requirement for immediate execution under the same Continuous Maintenance Availability (CMAV) schedule, and the contractor's unique capability and required equipment. The Contracting Officer determined costs are fair and reasonable based on historical data, an Independent Government Estimate (IGE), and the Project Manager's technical knowledge of estimated labor hours and material costs. The document was certified and approved by Lauren Heard, Contracting Officer (Code 426.2), with digital signature dated March 31, 2026.
