About this file
This document is a Justification and Approval (J&A) for Exception to Fair Opportunity for an emergency maintenance contract with the Department of the Navy's Mid-Atlantic Regional Maintenance Center. The contract (N0024-22-D-4407, Delivery Order N50054-25-FL035) involves repairing ventilation fan SS-29 on the USS San Antonio (LPD 17), which is critical for ensuring safe marine vehicle carbon monoxide operations and deck functionality. The work requires immediate action due to the time-sensitive nature of the ship's current maintenance period, with the repair needing to commence and complete within a condensed timeline to restore full mission capability and well deck operations.
The procurement is being executed as a sole-source acquisition under FAR 16.505(b)(2)(i)(A), with the contracting officer determining the anticipated costs as fair and reasonable based on historical data, Independent Government Estimate, and Project Manager technical knowledge. The emergency nature of the work prevented market research, and future similar acquisitions will be reviewed to promote full and open competition. The contract emphasizes the technical necessity of replacing both the motor and impeller together to prevent potential catastrophic fan failure, which would significantly impact the ship's operational readiness.
