About this file

This is a Justification and Approval (J&A) document for an exception to fair opportunity under a multiple delivery-order contract (IDIQ N00024-22-D-4413) issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.

The procurement concerns Air Conditioning Plant Compressor replacement work to be awarded to AIT-Marine as a sole-source delivery order under contract N00024-22-D-4412 (Cost-Plus, Firm Fixed-Price terms, delivery order N5005426FC006). The work was discovered after the initial contract package award and must be incorporated into Fiscal Year 2026 Operations and Maintenance (OM&N) funds. The justification cites FAR 16.505(b)(2)(i)(C) as the regulatory authority, permitting sole-source award as a logical follow-on to the original order provided all awardees received fair opportunity consideration. The rationale emphasizes operational urgency: the air conditioning plant is out of commission aboard ship, jeopardizing operational commitments and upcoming mission tasks. The A/C plant provides critical chilled water cooling for combat systems equipment and supports crew operations in extreme temperatures. The Contracting Officer determined anticipated costs are fair and reasonable based on historical data for similar work. Future similar acquisitions will be reviewed case-by-case to promote fair competition where practicable, and documentation will be forwarded to Planning and Engineering for consideration in future solicitations. The J&A is dated December 16, 2025, and certified by Allan Hall (Project Manager C320.2), Margaret Reach (Assistant Counsel C100), and Karina Tejada (Contract Specialist C426.1).

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY AND THE

SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE

THE ACQUISITION REQUIRES THE USE OF THE EXCEPTION CITED.

The regulatory authority for this procurement is FAR 16.505(b)(2)(i)(C). The order must be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees. All awardees were given a fair opportunity to be considered for the original order.

5. RATIONALE JUSTIFYING THE EXCEPTION TO FAIR OPPORUNITY

A/C Plant is OOC onboard . The operational commitments are in jeopardy . A delay in award will result in the ship being unable to meet their upcoming tasks. This A/C Plant supports critical combat systems equipment by providing chill water for cooling. This also supports the ship crew operating in extreme temperatures around the world.

6. DETERMINATION OF FAIR AND REASONABLE COSTS

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon past history related to this work requirement. The supported information provided should be sufficient to support the fair and reasonable cost determination of the procurement.

7. ACTIONS TO REMOVE BARRIERS TO COMPETITION

Future acquisitions for similar work will be reviewed by the Contracting Officer on a case by case basis to promote the use of fair competition in the delivery order award process under this multiple delivery-order contract, where possible and practicable in accordance with FAR Subpart 16.5. In addition, a copy of the change(s) covered by this justification will be forwarded to Code 200, Planning and Engineering, for consideration of similar work requirements in future solicitations.
