About this file
This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for the Department of State's Utility Management Program at Post Rangoon. The document justifies a sole-source acquisition from Utility Systems Technologies (UST) for rehabilitation of the embassy's low voltage automatic voltage regulator (LV AVR), with an estimated contract value of $125,000. UST will provide factory-certified technicians to diagnose, repair, and recommission the inoperable LV AVR, which is critical to the embassy's utility power system and currently forcing operation on emergency generators.
The justification is based on FAR 6.302-1, citing UST as the sole manufacturer with proprietary knowledge of the equipment and the only company able to provide a six-month warranty for the work. The document emphasizes that UST is the only source with factory-certified technicians capable of technically acceptable service according to Department of State guidelines. The Independent Government Cost Estimate (IGCE) was verified as fair and reasonable by OBO/OPS/FAC/PS/UM - PowerSupport, and no market survey was deemed necessary due to the unique nature of the required services.

Utility Management Program - PowerSupport – Post Rangoon
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION
1. RECOMMENDATION
PowerSupport recommends that the Department of State use other than full and open competition for the acquisition of electrical labor, services, and equipment for the rehabilitation of embassy Rangoon’s low voltage automatic voltage regulator (LV AVR). These services will be provided by Utility Systems Technologies (UST) at an estimated cost of $125,000.
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED
UST will provide factory certified technicians to manage and perform on-site, hands-on replacement and repair services for post’s LV AVR that is currently inoperable due to component failures . The LV AVR is instrumental to the functionality of the utility power system. Since this unit is not in operation, post has been forced to operate on their emergency generators.
3. DESCRIPTION OF SUPPLIES AND SERVICES
UST will provide parts and labor required to determine whether or not the unit can be repaired. If a repair is feasible, UST will perform all tasks within the corresponding scope of work and provide the necessary parts to recommission the unit and satisfy post’s power requirements.
4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND
OPEN COMPETITION
FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. UST is the sole manufacturer of this equipment and obtains the necessary knowledge to perform these services on-site. Additionally, UST is the only company that can provide a warranty to cover problematic conditions for up to six (6) months beyond re-commissioning.
5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR
THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED (FOR SOLE
SOURCE ACQUISITIONS; ALSO REQUIRED FOR UNUSUAL AND COMPELLING URGENCY
WHERE MORE THAN ONE OFFER WILL NOT BE SOLICITED).
Only UST can provide on-site services using factory certified technicians and a proposal technically acceptable based on Department of State guidelines. Should another contractor be hired to perform this task our post would be left at a substantial risk by allowing other than factory certified technicians access to the equipment and not having a guaranteed product upon completion of the scope. The government could not reasonably expect to secure a technically certified, guaranteed product from other sources. The cost for any attempt to do so could not be expected to be recovered through open competition.
6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS IS PRACTICABLE. THE DESCRIPTION SHOULD INCLUDE
WHETHER A FEDBIZOPS NOTICE WAS OR WILL BE PUBLICIZED, AS REQUIRED BY FAR 5.2,
AND IF NOT, WHICH EXCEPTION UNDER FAR S.202 APPLIES (E.G., BLANKET WAIVER
PROVIDED IN DOSAR 605.202-70).
FedBizOps is not used under the current contract. The contractor selected to perform this task is the only source available with factory certified technicians and the proprietary institutional knowledge of the equipment.
7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE
GOVERNMENT WILL BE FAIR AND REASONABLE.
The IGCE is based on a careful calculation of contractor hours and rates. The lGCE was verified as fair and reasonable by OBO/OPS/FAC/PS/UM - PowerSupport.
8. A DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND THE RESULTS OR A STATEMENT
OF THE REASONS A MARKET SURVEY WAS NOT CONDUCTED.
A market survey is not necessary due to the fact that only one reasonable source and no other supplies or services are available to satisfy agency requirements.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION.
NA
10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUTSITION.
11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVEROME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR
THE SUPPLIES OR SERVICES REQUIRED.
