I. Contracting Activity.

II. Nature and/or description of the action being processed.

This action is a new firm-fixed price contract for the procurement of software source code licenses from Radisys.

The Government intends to negotiate a sole source contract with: Radisys Corporation, 8900 NE Walker Rd. Suite 130, Beaverton, Oregon 97006.

III. Description of supplies/services required to meet agency needs.

The required software source code licenses and support consist of the following items:

1000674 - 5GNR SA Intel Sub6GHz CU (Source) 1000674 - 5GNR SA Intel Sub6GHz DU Intel CL (Source) 1000678 - L1 High Sub6GHz on Intel (FlexRAN 5G) (Source) 1000674 - 5G SA Intel Sub6GHz CU Advanced - InterRAT HO 1000674 - 5G SA Intel Sub6GHz DU Advanced - InterRAT HO

The software licenses are perpetual, and all documentation, training, and updates for each of the five (5) software modules is included.

IV. Statutory authority permitting other than full and open competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

In FY21, AFRL purchased a 5G Cellular Network from Radisys - under the current procurement the software and support to run this network is being procured. Radisys provided a detailed hardware configuration and specifications supported by their software. AFRL is currently operating the Radisys software in binary form of the 5G testbed. To further the Government's research and development capabilities, access to the source code software for these components is necessary. Radisys, as the manufacturer of the hardware and software, is the only company with access to the source code of their software binaries and only source authorized to sell the licenses and providing the source code.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Pre-Solicitation Notice outlining the Government's intent to make a sole source award to Radisys was posted to the BetaSAM.gov website 07 - 22 JUN 2022. While two responses were received, review by the Program Manager concluded that there was no indication that a company other than Radisys could fulfill the Government's requirement.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

13.106-3(a)(2)(ii) Comparison of proposed price with prices found fair and reasonable on previous purchases of the same or similar items in the same industry.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

No other company, other than the manufacturer Radisys, has legitimate access to the source code of the software that is currently in-use at AFRL/RI. Open-source alternative solutions are not as mature as the Radisys software solution and/or do not offer the same capabilities. Some other solutions use Intel binary software without providing the Intel software code, and therefore will not meet AFRL's needs.

A Notice of Contract Action posted on BetaSAM.gov 07 - 22 JUN 2022 returned no results that would indicate a source other than Radisys could fulfill the requirement.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

This requirement is not available through any mandatory or strategic sources. Market Research of previous AFRL/RIKO purchases of similar items yielded sole source requirements, as true competition has not stemmed from any solicitations, nor has an equal product been found.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Government will continue to monitor the market in order to identify opportunities to maximize competition in potential future requirements and in the event that the research and development activity changes, or other products will once again be evaluated to determine their capability to support future projects.
