JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Carderock Division, Contracts Division Code 4112.
2. Description of the Action Being Approved
This is a commercial item to be awarded without providing for full and open competition. The proposed contract action is a new firm fixed-price contract to be awarded to to Star Dynamics that can provide a system upgrade to the existing Elan ’98 Radar System.
Aeroflexprocurement is for materials and services to upgrade/enhance NSWCCD’s Elan ’98 Radar System purchased in the late ‘90’s from Aeroflex-Lintek (which spun off its RCS Radar business to Star Dynamics 2 years ago) through an open competition.
3. Description of Supplies/Services
NSWCCD requires the purchase of a system upgrade of the existing Elan 98 radar system. Major digital components in the Elan ’98 are obsolete and not maintainable or replaceable. These upgrades will provide a digital upgrade which will bring the Elan ’98 up to the quality and maintainability of Star Dynamics new Blue max G6 systems currently being produced. The new capability will also include the following: Digital Upgrade of Elan 98 Radar System to BlueMax G6 (includes 4 Data Acquisition Cards) for , Additonal 4 Data Acquisition Cards for each totaling for 4, GPS/IRIG-B feature for , Auxiliary Data Port Feature for , Front End Control Box D Chassis for , and Distribution and Band Leveling Chassis for coming to a grand total of .
These eight data acquisition cards will expand the data acquisition rates to enable higher data rates required for current and future applications. This system upgrade shall be delivered by 3 months after receipt of equipment to be upgrade and is to be funded with Fiscal Year 2013 funding.
The Government’s minimum needs have been verified by certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open
Competition
The statutory authority permitting other that full and open competition is 10 U.S.C. 2304(c) (1). Only a limited number of responsible sources and no other supplies or services will satisfy agency requirements (FAR 6.302-1).
5. Rationale Justifying Use of Cited Statutory Authority
The upgrade/enhancements to NSWC’s Elan Radar System involve changes to the Star Dynamic’s (formerly Aeroflex Lintek) supplied hardware and software. To implement these changes requires a detailed knowledge of the radar systems electronic circuitry and software. As the designer and manufacturer, Star Dynamics is uniquely qualified to perform these system modifications. They possess all of the required technical data and have a good working knowledge of the software. If a third party vendor where used, NSWC would have to provide them with a very detailed and complete technical information package on the Elan radar. Even with that package, they would be on a learning curve that would be extensive, if not impossible, and cause excessive expense. Also, a third party vendor would not have access to any proprietary design information from Star Dynamics (formerly Aeroflex Lintek). It would be questionable if a third party vendor would make the optimum modifications sue to their lack of experience with the Elan Radar. Additionally, our performance based SOW and specification would have to be expanded to include a lot more technical requirements to ensure that the upgrade/enhancements are properly implemented.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
In accordance with FAR 5.203(a) (2) a synopsis was posted on the web via the Federal Business Opportunities (FedBizOps) website on 19 April 2013.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWCCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCCD will assess whether competition for future requirements is feasible.
