About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for the GSA Region 5 Customer Projects Repair and Alterations Indefinite Delivery Indefinite Quantity (IDIQ) contracts.
The JOFOC states that GSA Region 5 has a continuing need for construction services to renovate federal and leased space throughout the region, which is currently fulfilled by twenty existing IDIQ contracts that are set to expire on June 3, 2024. To avoid a break in service, GSA is seeking to extend the existing IDIQ contracts under the authority of FAR 6.302-2 for unusual and compelling urgency. The extension is necessary to maintain building operations and safety for government agencies and the public. The twenty incumbent IDIQ contractors have the necessary skills and familiarity with GSA Region 5 to perform the required work efficiently. The total estimated value of services during the extension period is $8.2 million. While a new IDIQ solicitation has been initiated, it will not be in place prior to the current contracts' expiration. GSA will take steps to promote competition for the follow-on IDIQ, including synopsizing the opportunity on SAM.gov.

GSA GREAT LAKES REGION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
GSA R5 CUSTOMER PROJECTS REPAIR & ALTERATIONS IDIQ
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY
General Services Administration (GSA), Public Buildings Service, Region 5, Acquisition Management Division.
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED
GSA Region 5 has a continuing need for construction services to renovate federal and leased space located throughout GSA Region 5. The Region utilizes twenty existing Indefinite Delivery Indefinite Quantity (IDIQ) Repair & Alterations Services contracts to obtain these services. The IDIQ contracts are due to expire on June 3, 2024. While new IDIQ contracts are currently being solicited, they will not be in place by this date. For the Region to continue to provide repair and alterations in a quick and efficient manner, it is necessary to extend the current IDIQ contracts to avoid a break in availability.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS
The IDIQ contracts cover repair and alterations projects at GSA owned and leased facilities throughout GSA Region 5, which is composed of the states of Minnesota, Wisconsin, Illinois, Michigan, Indiana, and Ohio. The twenty IDIQ contractors provide the management, supervision, manpower, equipment, and supplies necessary to perform these services. The contractors ensure the expeditious delivery of repair and alteration projects for various buildings via the placement of task orders issued against the contracts. The task orders are solicited competitively among the IDIQ contractors. It is estimated that approximately $8.2m of services will be required during the extension period.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION
FAR 6.302-2 permits contracting without providing for full and open competition when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
GSA Region 5’s experience indicates that without multiple award IDIQ contracts in place, the delivery of repair and alteration projects would not occur efficiently enough to maintain all the building assets. This could result in the buildings becoming inoperable or unsafe for the employees and public who require access, and impede or prevent Government agencies from performing their critical missions. Multiple award IDIQ contracts will help to ensure the safety of the building occupants while providing continuity of building repairs and alterations.
The delay in soliciting and awarding the new IDIQ contracts is due to internal staffing shortages in both the technical and contracting divisions that have severely limited the resources needed to prepare the requirements and conduct the procurement, as well as delays in obtaining approval for a revised pricing structure, both of which were not foreseeable at the time the initial contract was entered into, and were not conditions that could have been anticipated or planned for in advance.
As indicated above, the extension is necessary to ensure the continuity of services.
The total period of performance covered by the extension is limited to the time needed to meet the unusual and compelling requirements of the work to be performed under the IDIQ contracts, and for the agency to enter into new IDIQ contracts for the required services through the use of competitive procedures.
5. A DEMONSTRATION THAT THE PROPOSED CONTRACTORS’ UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE
OF THE AUTHORITY CITED
The intention is that the twenty IDIQ contracts will be extended. The contractors are all high performing with the necessary skills and organizational structure to perform the required work, and are very familiar with GSA Region 5 buildings, procedures, and project requirements, which will allow for the solicitation and completion of the projects efficiently.
6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE
Due to the nature of the extension, this particular contract action will not be synopsized on SAM.gov. However, the solicitation for the new IDIQ has been synopsized and will be posted on SAM.gov and additional efforts will be made to publicize the procurement to ensure as many potential sources as possible are notified.
7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
Cost estimates will be prepared at the task order level as required. In addition, solicitations issued under the IDIQ are done so on a competitive basis. These steps will ensure the Government receives a fair and reasonable price for the services.
8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED
Market research is not considered practical for this extension. However, extensive market research was conducted in connection with the solicitation of the new IDIQ.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
Attempting to procure these services on the open market would not be efficient for such a short contract period. In addition, because there are twenty IDIQ contractors, we are assured that we have adequate competition at the task order level.
10. A LISTING OF SOURCES, IF ANY THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION
Current IDIQ contractors have indicated in writing that they are interested in the extension.
Additional sources were not sought due to the nature of the action, and the extension was not posted on the SAM.gov website. However, the solicitation for the new IDIQ will be posted on SAM.gov and interested firms will be encouraged to submit a proposal.
11. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE
OR OVERCOME ANY BARRIERS TO COMPETITION
Given the nature of this extension, there are no actions which could be taken to remove or overcome the existing barriers to competition as far as the current IDIQ is concerned.
12. CONTRACTING OFFICER'S CERTIFICATION
I hereby certify that the above information is accurate and complete to the best of my knowledge.
For the reasons stated, extending the IDIQ on an other than full and open competition basis is necessary to satisfy the agency’s requirements, and is in the Government’s best interests.
