JUSTIFICATION AND APPROVAL

TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action under our Request for Quote (RFQ) R3093955 is hereby recommended for approval pursuant to the authority of Title 41 U.S.C. 253(c)(1), and Federal Acquisition Regulation (FAR) 6.302-1(b)(1)(ii), which stipulates that the unique supplies or services are available from only one or a limited number of sources.

JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is the Defense Automatic Addressing System Center (DAASC) J6D; the contracting activity is the GSA Federal Acquisition Service, Mid-Atlantic Region (Region 03), Philadelphia, PA.

2. Nature/Description of Action.

Task order GSA0309DS6056 provides Websphere Exchange Conversion support to DAASC. The action currently being approved will add approximately 2,340 hours under the Principal Investigator labor category. This exception to fair opportunity is justified based on the client’s need for additional support relating to the Global Exchange (GEX) application. This work is within scope of the PWS. When this Firm Fixed Price task was awarded the level of development of the GEX application software was not fully known or anticipated. As of the end of the first option year period of performance a need now exists to add the equivalent of one plus FTE (2,340 hours estimated) in order to install and support the GEX software. In addition to installation and support, the additional hours will be utilized for informal and formal training to DLA personnel on the GEX products. This work will begin with the exercise of Option Year 2 and continue for the duration of the task.

3. Description of Supplies/Services.

The Contractor shall provide on-site technology to administer information assurance compliance for the Electronic Commerce Infrastructure (ECI) to include the Global Exchange (GEX) environment and the configuration services for the Global Exchange (GEX) software. DAASC has two separate operating locations to ensure high availability to the customer. The contractor will provide 24x7x365 support for both operating locations from the Dayton, OH site. Contracted personnel may also be required to work during base closures, work off-hours and carry a government furnished cellular device and respond (on-call) within DAASC guidelines. The contractor will provide informal and formal training to DLA personnel on the GEX products upon request.

The estimated value of Option Period 2 (January 1, 2011 through December 31, 2011 of this task order is $1,337,498.20.

4. Identification of Statutory Authority.

The statutory authority permitting other than full and open competition is Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 501), as implemented by FAR 8.405-6.

In accordance with FAR 8-405-6 (b)(i), only one source is capable of responding in the timeframe required due to the unique or specialized nature of the work.

5. Demonstration of Contractor’s Unique Qualifications.

The Defense Automatic Addressing System Center (DAASC) J6D requires the addition of (1) FTE to support the requirements identified in the current PWS; reference paragraph #1.0. The agency is positioning itself for the implementation of a new software architecture as projected and explained in the PWS. The GEX software will be utilized for routing the X12 transactions to the trading partner community. The existing PWS describes the implementation utilizing the GEX software. Resources are now required to fully support the GEX requirement.

6. Federal Business Opportunities (FEDBIZOPPS) Announcement/Potential Sources.

This acquisition will be synopsized in the Government-wide point of entry (GPE), per FAR 5.201. The GPE may be accessed via the Internet at http://www.fedbizopps.gov.

7. Determination of Fair and Reasonable Prices.

The GSA/FAS contracting officer will determine that the proposed prices under this requirement are fair and reasonable based upon historical data and a comparison of GSA Schedule price lists.

8. Description of Market Survey.

Market research was conducted at time of award. A review of the IT Schedule 70 and the scope of Rainbow Data System’s contract showed that they offer the required services under GSA IT Schedule # 70. Although many contractors have the same or similar labor categories as those offered by Rainbow Data Systems, RDS has the knowledge, expertise, and experience to meet the Government’s immediate need with the expected quality, reliability and expertise. Rainbow Data Systems has been supporting DAASC’s requirement for ten years, and is in a unique position to provide the expanded GEX support.

9. Any other supporting Facts No other supporting factors have been determined at this time.

10. Listing Of Other Interested Parties No other interested parties have been identified at this time

11. Action taken to remove barriers to competition All future requirements will be handled on a case-by-case basis.
