4. Identification of the Exception to Fair Opportunity. Procurement of Braud name ICT/E is authorized iu accordance with FAR 16.505(a)(4)) and is essential to the Goverumeut's requirements, thereby precluding consideration of products and services provided by other companies for the following reason:

[gJ f. This procurement maintains consistency with the current systems currently deployed and conforms to the accredited baseline. Attempting to integrate equivalent or nou-braud name products into the architectnre of the deployable mission support system (DMSS) would require significant redesign, testing, cybersecurity reaccreditatiou, and logistics activities.

The Government estimates that selection of equipment other than uame-braud items stated in this document would result iu the need to re-engineer or reconfigure equipment, additional training for personnel operating or maintaining the system, require additional application integration, Integration Verification and Validation (IV &V) testing, and resubmission of Certification and Accreditation (C&A). Additionally, if alternate equipment were selected, it would create new configuration management and sustainability risks that don't exist today.

The use of non-brand name or equivalent, non-tested equipment will result iu the loss of critical services for FLTCYBER. The requirements for an alternate architectnre would delay the ability for Fleet Cyber Command (FL TCYBER) to maintain its full mission capability up to a year. This delay would negatively impact FLTCYBER Cyber Protection Teams from fully performing their mission to defend priority DoD networks and systems against priority threats.

5. Determination of Fair and Reasonable Cost. The anticipated price to the Government will be fair and reasonable based ou price analysis as defined in FAR 15 .404-1 (b) to include a comparison against the Independent Government Cost Estimate (IGCE) and commercially available pricing.

6. Any Other Facts Supporting the Justification. None.

7. Actions Taken to Remove or Overcome Barriers that Led to the Exception to Fair Opportunity. The Government has conducted market research of other potential products.

Other products would require significant investment ou the part of the Government for the reasons listed in section 4f. They would not meet the system's Authority to Operate (ATO).

There are uo plans to procure other than the specific brand names listed in section 3. Any changes to the hardware baseline would require re-accreditation and result iu extensive testing and schedule delay. The Government will continue to perform market research as a part of its acquisition planning to identify cost effective emerging products and capabilities that can be incorporated into the system as components are replaced or upgraded. When other solutions are identified, the Government will compete each of those requirements and complete the mandated testing and cybcrsecurity requirements.
