FMC Carswell Solicitation 15BFA022Q00000100
Question Received (answer in bold):
Regarding 52.237-7:
In the state of Texas, there is a $250,000 limit on noneconomic damages against individual physicians, and a total “stacked” noneconomic cap of $750,000 if health care institutions also are found liable. The law features other crucial protections, such as providing personal immunity to physicians working for governmental entities, including state medical schools.
The above is per House Bill 4, the Medical Malpractice and Tort Reform Act of 2003 (https://capitol.texas.gov/tlodocs/78R/billtext/html/HB00004F.htm).
As such, it is standard practice in Texas healthcare institutions to require physician liability insurance with $200,000/$600,000.
In order to meet standard practice in the state of Texas, we respectfully request that the following amount(s) for contract liability insurance per specialty per occurrence be adjusted to: $500,000 with a $1,500,000 aggregate limit.
Answer: After further market research please see amendment 00001 to the solicitation updating clause 52.237-7.
Question Received (answer in bold):
Regarding "Documentation to be submitted with Quote" on page 14, specifically item 4. Past Performance Questionnaire:
The section states that Attachment 2 must be submitted. However, as stated on Page 15, past performance evaluation is conducted based on one or more of several factors listed.
I have never performed contract work like this, so it would be inappropriate for me to fill out Attachment 2. I can however, discuss my experience within the field to include education as well as case familiarity as an indication of expertise.
I respectfully request that it be allowed to submit a summary of training and specific procedural expertise in lieu of Attachment 2.
Answer: The past performance we are looking for is specific to Gender Reassignment Surgeries, not specific to “contract work”. The questionnaire is not intended to be filled out by the quoter, but by references, such as, but not limited to, patients, Executive Hospital Staff/Executive Surgery Center Staff where surgeries have been performed, etc.
The requirement to submit Attachment 2, Past Performance Questionnaire remains standing, thank you.
