About this file

This is a Questions and Answers document for RFP #RBAA 2026-0214 issued by the Colorado Department of Public Safety (CDPS) for Background Check Polygraph Services. The document addresses inquiries from prospective vendors regarding service expectations and contract specifications. The department requires vendors to complete 30 to 50 polygraph examinations monthly, with peak demand occurring during August-September and January through March. Vendors must utilize testing formats and question batteries approved by the department, which will be finalized post-award and prior to candidate referrals. Each polygraph examination must include a written report and audio/video recordings, with the report submitted to CDPS Human Resources within three business days of the exam and recordings maintained by the vendor for departmental access upon request. Exhibit A, Section 2.A.a.vii requires vendors to be available for consultation with the Attorney General's Office regarding polygraph-related appeals, though such requests have been infrequent historically.

Pricing for this contract is not publicly disclosed to encourage competitive bidding and optimal vendor proposals. Travel time and mileage reimbursement outside the Denver Metro area are not separately compensated; vendors must either include these costs in their per-exam pricing or indicate any variance in pricing for services outside the Denver Metro area in Exhibit B. The incumbent service provider information is not disclosed and requires a Colorado Open Records Act request. The department indicated no specific service gaps or improvement areas are being addressed with a new provider, suggesting general continuity of current service levels. Annual price escalation is permitted under Colorado regulations (R 24-103-503), with methods for determining any escalation to be specified in the original contract specifications, and contract renewal contingent upon fund availability for subsequent periods.

Request for Proposal (RFP) #: RBAA 2026-0214 Project Title: Background Check Polygraph Services

Date 05/08/2026 Amendment #1 Q&A

Questions and Answers

Q1: While the evaluation criteria includes the vendor's capabilities to "complete large numbers of polygraphs (30-50 per month)," what has been the historical annual volume under prior contracts?

A1: The department needs have averaged 30 to 50 per month with “peak” hiring periods being August-September and Jan-February and February-March.

Q2: Who is the incumbent service provider?

A2: A Colorado Open Records Act (CORA) request would need to be submitted for that information.

Q3. Are there any specific service gaps, pain points, or areas of improvement CDPS is looking to address with a new provider, such as turnaround time, reporting quality, customer support responsiveness, or platform/technology functionality?

A3: No

Q4: Could CDPS share the current contract's pricing structure?

A4: Current costs can’t be disclosed in order to promote competitive bidding and encourage responding vendors to present their best solution.

Q5. What is the anticipated budget or budget range allocated for this contract?

A5: The budget for this project is not disclosed to promote competitive bidding and encourage responding vendors to present their best solution.

Q6: Is annual price escalation permitted under the resulting contract? If so, is there a cap on the percentage increase per year?

A6: Regarding Options, R §24-103-503 states, “Specifications for multi-year contracts shall contain conditions of renewal or extension, if any. Methods used to determine any price escalation/de-escalation shall be part of the original specifications and made a part of the contract. Contracts shall only be renewed or extended if funds are available for the new contract period.”

Q7: When vendors travel outside the Denver Metro area to conduct polygraph exams, is travel time and mileage reimbursed separately, or is it expected to be included within the per-exam price?

A7: No, the travel time and mileage is not reimbursed. Should a vendor not offer services outside the Denver Metro area on a permanent basis, the proposal must indicate any variance in cost per exam offered outside of the Denver Metro area. Offerors can list any additional information on pricing in Exhibit B – Pricing under section 2.

Q8: Section 2.A.a.v of Exhibit A states the vendor must use a testing format and question battery approved by the Department. Is there an existing approved format that the awarded vendor will be expected to adopt, or will the vendor submit their format for approval post-award? What is the anticipated timeline for that approval process?

Request for Proposal (RFP) #: RBAA 2026-0214 Project Title: Background Check Polygraph Services

Date 05/08/2026 Amendment #1 Q&A

A8: Post award the department will engage with the vendor to ensure the criteria is consistent across all vendors CDPS utilizes. This will occur shortly after the award and prior to referring any candidates to the awarded vendor.

Q9: Exhibit A, Section 2.A.a.iii requires audio/video recordings to be submitted with each polygraph report. Can CDPS specify the required file format, delivery method (e.g., encrypted drive, secure portal), and any chain-of-custody requirements for these recordings?

A9: Polygraph written report and subsequent analysis and determination of the polygraph exam must be submitted to CDPS Human Resources within three (3) business days of the performance of the polygraph exam. The related audio/video tapes for each polygraph that is performed must be kept on file by the polygraph vendor and made available to CDPS HR within 3 business days upon request.

Q10: How frequently has CDPS historically required vendor testimony or phone consultation with the Attorney General's Office for polygraph-related appeals, as referenced in Exhibit A, Section 2.A.a.vii?

A10: Infrequent. Should a complaint regarding the service be received, it is investigated by the CDPS HR who will contact the vendor and request to pull the original exam tapes for a review.
