About this file
This is a Questions and Answers document issued by the Massachusetts Department of Youth Services (DYS) in response to inquiries regarding RFR DYS POS 2026-13, which seeks to procure two pre-independent living programs serving males statewide. The programs will accommodate 5-11 youth and provide safe, supportive placements primarily for older adolescents and emerging adults with on-site support from caring adults. The programs will serve youth from all five DYS regions as needed throughout the contract term. No bidder's conference was held for this procurement.
The pricing structure utilizes a daily rate of $493.50 per client, with staffing costs embedded in this rate across all bed count levels. Contract maximum obligations vary based on bed count, ranging from $810,574 for a 5-bed model at 90% utilization to $1,296,918 for an 8-bed model at 90% utilization. The daily rate remains consistent regardless of whether the program operates at 5-bed or 8-bed capacity. Providers are eligible to submit quarterly settlement requests for reimbursement of underutilized programs. The FY26 contracts incorporate Chapter 257 rate increases effective January 1, 2026, reflecting a full-year rate structure that was not previously available with the 5-11 bed model option.

QUESTIONS AND ANSWERS
The following questions were submitted electronically:
Q: The chart on pages 8 and 9 of the RFR does not reflect the current Chapter 257 rate for FY 26 contracts.
· Can this be reviewed and explained in detail as there is no Bidder’s Conference to discuss?
A: The FY 26 contracts did not reflect a full year of Chapter 257 101 CMR rate increases, effective 1/1/26, and there was not a 5-11 bed model as an option prior to the recent Chapter 257 update.

Q: When reviewing the proposed rate structure in each RFR it says that the rates will follow the Chapter 257 Guidelines but the included rate chart has the same daily rate listed for utilization at 5 clients and for 8 clients which appears that whoever the contract is awarded to will no longer be “made whole” in recognition of the staffing that is required at all times regardless of utilization. Can you please let us know if that is correct?
A: For the pre-independent living program, the 5-11-bed model staffing is embedded in the daily rate. The program will bill monthly utilization at a daily rate of $493.50. Based on the bed count, the contract maximum obligation will vary. In addition, providers are eligible to submit quarterly settlement requests for reimbursement of underutilized programs.
