About this file
This document is an Amendment 2 to an Invitation for Bid issued by the South Carolina Department of Agriculture for a Waste Pesticide Recovery Collection Program. The solicitation seeks a contractor to manage collection events for waste pesticide materials and laboratory waste from the SC Department of Agriculture. The contractor must provide collection event services scheduled on an as-needed basis, with each event operating from 9:00 AM to 2:00 PM and requiring setup beginning at 8:00 AM. The contractor is required to supply at least one chemist and one truck driver at each event, maintain a forklift at every collection site, and possess the capability to remove up to 100,000 pounds of waste materials per scheduled collection. The solicitation deadline for submission is January 15, 2025, at 2:00 PM, with bid opening scheduled for the same date and time at the Consumer Protection Laboratory in West Columbia, South Carolina. The non-mandatory pre-bid conference was held on December 11, 2024, at 2:00 PM. Award notification is scheduled for January 17, 2025, and all bidders must acknowledge receipt of amendments and sign the required cover pages.
The solicitation references a 5-year collection history (Attachment A) detailing previous collections to inform bidder estimates. Contractors must respond within seven business days to requests for supplies or additional services not delivered during waste pick-up events. The amendment clarifies that the SC Department of Agriculture will not provide previous invoices but has incorporated historical collection data into the solicitation package. All pesticide materials will be transported to centralized one-day collection events rather than picked up at individual generator locations. The State anticipates that laboratory waste may expand to include hazardous waste materials not previously documented as the laboratory's scope of testing evolves. Contractors must acknowledge receipt of this amendment and all previous amendments by identifying amendment numbers and dates on the submission cover page.

PREFERENCES - A NOTICE TO VENDORS (SEP. 2009): On June 16, 2009, the South Carolina General Assembly rewrote the law governing preferences available to in-state vendors, vendors using in-state subcontractors, and vendors selling in-state or US end products. This law appears in Section 11-35-1524 of the South Carolina Code of Laws. A summary of the new preferences is available at www.procurement.sc.gov/preferences . ALL THE PREFERENCES
MUST BE CLAIMED AND ARE APPLIED BY LINE ITEM, REGARDLESS OF WHETHER AWARD IS MADE BY
ITEM OR LOT. VENDORS ARE CAUTIONED TO CAREFULLY REVIEW THE STATUTE BEFORE
CLAIMING ANY PREFERENCES. THE REQUIREMENTS TO QUALIFY HAVE CHANGED. IF YOU
REQUEST A PREFERENCE, YOU ARE CERTIFYING THAT YOUR OFFER QUALIFIES FOR THE
PREFERENCE YOU'VE CLAIMED. IMPROPERLY REQUESTING A PREFERENCE CAN HAVE SERIOUS
CONSEQUENCES. [11-35-1524(E)(4)&(6)]
PREFERENCES - ADDRESS AND PHONE OF IN-STATE OFFICE: Please provide the address and phone number for your in-state office in the space provided below. An in-state office is necessary to claim either the Resident Vendor
Preference (11-35-1524(C)(1)(i)&(ii)) or the Resident Contractor Preference (11-35-1524(C)(1)(iii)). Accordingly, you must provide this information to qualify for the preference. An in-state office is not required, but can be beneficial, if you are claiming the Resident Subcontractor Preference (11-35-1524(D)).

THE SOLICITATION IS AMENDED AS PROVIDED HEREIN. INFORMATION OR
CHANGES RESULTING FROM QUESTIONS WILL BE SHOWN IN A QUESTION-AND-
ANSWER FORMAT. ALL QUESTIONS RECEIVED HAVE BEEN REPRINTED BELOW.
THE “STATE’S RESPONSE” SHOULD BE READ WITHOUT REFERENCE TO THE
QUESTIONS. THE QUESTIONS ARE INCLUDED SOLELY TO PROVIDE A CROSS-
REFERENCE TO THE POTENTIAL OFFEROR THAT SUBMITTED THE QUESTION.
QUESTIONS DO NOT FORM A PART OF THE CONTRACT; THE “STATE’S RESPONSE”
DOES. ANY RESTATEMENT OF PART OR ALL OF AN EXISTING PROVISION OF THE
SOLICITATION IN AN ANSWER DOES NOT MODIFY THE ORIGINAL PROVISION
EXCEPT AS FOLLOWS: UNDERLINED TEXT IS ADDED TO THE ORIGINAL PROVISON.
STRICKEN TEXT IS DELETED.
The purpose of this amendment is to provide answers to questions received from the vendor community, revise the bid opening/submission date, and to revise the posting of the notice of award date, as reflected on page one of this solicitation.
The bid opening will take place on 1/15/2025 at the following location at 2pm:
Consumer Protection Laboratory
123 Ballard Court
West Columbia, SC 29172
Received Questions and the States Response:
Question 1: Are events scheduled in a particular way (i.e. by region per week) or are the events just arranged on an as needed basis with the times and locations varying based on need?
States Response: Events will be scheduled on an as needed basis. Every event will be from 9am to 2pm. The contractor will be required to begin setting up at 8am the day of the event.
Question 2: Will the contractor be required to service pesticide pick-ups at generator locations or will all pesticide materials for management be brought to one day collection events?
States Response: All pesticide materials will be brought to the one-day collection events.
Question 3: Is a forklift required at every event?
States Response: The Contractor is required to have a forklift at every event.
Question 4: What are the typical hours for a collection event?
States Response: See answer to question 1.
Question 5: On average, how many staff does the current contractor provide for a collection event?
States Response: The Contractor will be required to provide at least one Chemist and one Truck Driver at each event.
Question 6: How many shipments per year, on average, are greater than 1 truckload of material?
States Response: There is no way to predict how much will be collected at a given collection. The Contractor must possess the capabilities and necessary trucks to remove up to 100,000 pounds of waste at all scheduled collections.
Question 7: Will SCDA provide shipping documentation and invoices for pesticide collection shipments for the last 3 years?
States Response: The State will not provide previous invoices for collections or lab waste collected over the past three years. The State is incorporating attached 5-Year collection data into this solicitation as Attachment
A. The attachment details every scheduled collection and lab waste collection over the last five years.
Question 8: Will SCDA provide shipping documentation and invoices for lab waste shipments for the last 3 years?
States Response: See answer to question 7.
Question 9: Will the SCDA lab generate biohazardous, radioactive, or any waste regulated beyond RCRA
Hazardous Waste and Solid Waste regulations?
States Response: No.
Question 10: Will SCDA generate Hazardous Waste materials not represented on previous shipment documents for lab waste shipments?
States Response: Yes, that is possible given changes in the scope of testing within the laboratory.
Question 11: For supplies requested by SCDA lab that would not be delivered during waste pick-ups, what response time would be deemed acceptable?
States Response: The Contractor is required to respond within 7 business days of notification of need by the
State.
All terms and conditions remain unchanged.
