8(a) STARS II Open Season

QTA0015MDA2001

Amendment 02

The purpose of this amendment is:

1. Replace 52.212-2 in EVALUATION section with the following text:

FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following approximately equal factors/criteria shall be used to evaluate offers:

1. A completed Standard Form (SF) 1449,

2. RFP Requirements Compliance,

3. Contract Administration Plan (CAP),

4. Marketing Action Plan (MAP),

5. Industry Credential (Constellation II only),

6. Past Performance,

7. Price,

8. Responsibility, and

9. Current Representations and Certifications from SAM.gov, which satisfies 52.212-3, identified as “Clauses and Provisions” in the portal.

See the entirety of this Evaluation Section.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

2. In CONTRACT REQUIREMENTS section:

a) Rename “18. OPEN SEASON PROCEDURES” to “19. OPEN SEASON PROCEDURES”

b) Insert “18. RESERVED”

3. Add the following text to EVALUATION section B.6.3.6.:

B.6.3.6.1. For a joint-venture offeror proposing in Constellation II it is sufficient that one member of the joint-venture possess the designated industry credential.

4. Replace the last sentence of the first paragraph of A.6.3. and B.7.4. in the EVALUATION section with the following text:

A.6.3. “Offerors are responsible for submitting completed past performance surveys in the electronic proposal in the portal.”

B.7.4. “Offerors are responsible for submitting completed past performance surveys in the electronic proposal in the portal.”

Amendment 02

5. Add the following text to EVALUATION section A.6.3. and B.7.4.:

A.6.3.2. A predecessor company’s past performance might be attributed to the offeror, but the offeror has the burden to establish that such past performance should be attributed to the offeror. To do so, the offeror must demonstrate the nature and extent of the relationship between the two organizations, in particular whether the workforce, management, facilities, or other resources of the predecessor company beneficially affects contract performance by the offeror/beneficially propagates to the offeror. The past performance survey and the past performance summary are venues for such an effort.

A.6.3.3. Individual past performance of an offeror’s key employees might be attributed to the offeror, but the offeror has the burden to establish that such past performance beneficially affects contract performance by the offeror/beneficially propagates to the offeror. The past performance surveys and the past performance summary are the venues for such an effort.

B.7.4.3. Individual past performance of an offeror’s key employees might be attributed to the offeror, but the offeror has the burden to establish that such past performance beneficially affects contract performance by the offeror/beneficially propagates to the offeror.
