Offerors that fail to furnish required representations or information, or reject the terms and conditions of the solicitation, may be excluded from consideration.

3. Offeror(s) are responsible for submitting proposal, and any amendments, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Any proposal, amendment, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and may not be considered.

4. Item 1, Seals, Antipilferage (Self Locking), NSN 5340-00-901-8105, in the solicitation will be set aside for small business concerns. The Buy American Act, FAR 52.225-1-Supplies, applies to this item.

7.

The Government intends to evaluate offers and award contract without discussion with offerors in accordance with Federal Acquisition Regulation 52.212-1 (g), therefore, offerors are encouraged to submit their best offer with their initial proposal submittal. However, the Government reserves the right to conduct discussions, if later determined necessary by the Contracting Officer.

8.

The Economic Price Adjustment (EPA) clause will be applicable to the four one-year option periods. See Clause 552.216-71 – ECONOMIC PRICE ADJUSTMENT—STOCK AND SPECIAL ORDER PROGRAM CONTRACTS (SEP 1999) (ALTERNATE II—SEP 1999).

10. Forest Service Specifications referenced in the item purchase descriptions (IPDs) can be found on the website at http://www.fs.fed.us/t-d/programs/fire/specs.htm.

13. Delivery for all items is required in accordance with Clause 552.211-94 on page 32 of this solicitation. Deviation from the required delivery schedule may result in your offer being non-responsive and no longer considered for possible award.

14. Source Inspection is required for all items.

15. E-Verify applies to Item 2, Gasoline Can, NSN 7240-01-044-5523, in the solicitation as it is not considered a commercial off the shelf item (COTS).

16. A subcontracting plan in accordance with FAR clause 52.219-9 will also be reviewed as applicable. An offeror, other than a small business concern, submitting a proposal that exceeds $650,000 shall submit a subcontracting plan with their initial offer.

Past performance information from available sources will also be evaluated. All offers must conform to the solicitation to be determined responsive for consideration of possible contract award. (See Clause 52.212-2 Evaluation—Commercial Items on pages 79 – 80.)

22. Technical Data Required with Offer Submittal and Price for Evaluation: Offerors are advised that the required data described in Clause 52.212-1 Instructions to Offerors—Commercial Items (pages 74 – 78) will be utilized for review and evaluation to determine technical acceptability and responsibility for possible contract award. The Government will not make assumptions concerning the offeror’s intent, capability, facilities, or certifications/registrations. Clear identification is the sole responsibility of the offeror. Failure to provide required data may result in offer being determined non-responsive and no longer considered for possible contract award.

23. Facilities Inspection: Technical capability may also be determined by a pre-award assessment report (PAR) conducted by GSA personnel at the offeror’s facility. The assessment will include, as a minimum, offeror’s facility capacity, quality assurance system, and demonstration of compliance with all requirements. Failure to receive an overall recommendation of “Capable of Performing” the requirements of a resulting contract, if awarded, may result in the offer no longer being considered for award.

The containers or items shall be placed in a suitable pattern to form a stable and balanced load. Vertical, horizontal or filler reinforcement shall be added as necessary to meet the stacking strength requirements. A palletized load shall be secured to the pallet by shrink or stretch wrapping, and/or, by steel or nonmetallic strapping. When steel or nonmetallic strapping is used, edge protectors shall be provided to prevent damage to the cartons when tensioning the strapping. As a minimum, two straps shall run lengthwise, two straps shall run widthwise, and two straps shall run around the girth of the palletized load. A palletized load shall be capable of protecting the products against damage in a multiple handling, transportation, and storage environment having distribution warehouses with rack systems that support the load/s overhead of warehouse personnel.

Notice of special requirements for shipment to all countries that have endorsed the IPPC Guidelines for treatment of non-manufactured wood packaging: The International Plant Protection Convention (IPPC) has approved and published on March 15, 2002, “Guidelines for Regulating Wood Packaging Material in International Trade”.
