SIGNIFICANT CHANGES (OCT 1988)

The attention of offeror is invited to the following changes made since the issuance of the last solicitation for the supplies/services covered herein:

1. Offerors are directed to Clause 52.212-1 - Instructions to Offerors herein, with addendum, for instructions on technical data required with submission of offer or for evaluation. Offerors are cautioned to carefully review the entire solicitation. Offerors are strongly urged to use two-sided copying of offers for submission to GSA, if mailed. The preferred method to submit offers is electronically to email address: linda.haffner@gsa.gov. Facsimile offers will not be accepted.

2. Offers shall be submitted on the Standard From 1449. Offer shall include all subsequent pages following this form. Sign and date your offer; an original must be received for award. Offerors that fail to furnish required representations or information, or reject the terms and conditions of the solicitation, may be excluded from consideration. Offer submission is required in this format. This supersedes clause 52.212-1 - Instructions to Offerors - Commercial Items (June 2008) paragraph (b).

3. FAR SUBPART 25.4 -- Trade Agreements applies to all items.

4. Offeror(s) are responsible for submitting proposal, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Any proposal, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and may not be considered.

- 1 - 5.

Award will be made in the aggregate for all items. Failure to submit pricing for each item will deem your offer non-responsive and prevent your offer from being considered for further evaluation for possible contract award.

6. To be determined responsive and continued to be considered for possible contract award, offers must include evidence of registration to ISO 9001, Quality Management Systems - Requirements, at time of offer submittal.

7. NFPA 1977. The pants shall be third party certified as being in compliance with National Fire Protection Association (NFPA) Standard 1977, Protective Clothing and Equipment for Wildland Fire Fighting, 2011 Edition. Proof of this certification (2011 Edition) shall be presented at the time of First Article submission. Evidence of obtaining third party certification to NFPA 1977 (2011 Edition or 2005 Edition) on similar or like products in offeror's current product line is required at offer submittal for technical acceptability evaluation determination.

8.

The Government intends to evaluate offers and award contract without discussion with offerors In accordance with Federal Acquisition Regulation 52.212-1 (g), therefore, offerors are encouraged to submit their best offer with their initial proposal submittal. However, the Government reserves the right to conduct discussions, if later determined necessary by the Contracting Officer.

9.

Contract awarded from this solicitation will be for a one (1) year firm fixed base contract with four (4) one year option periods. The Economic Price Adjustment (EPA) clause will be applicable to the four one-year option periods. See Clause 552.216-71 – ECONOMIC PRICE ADJUSTMENT—STOCK AND SPECIAL ORDER PROGRAM CONTRACTS (SEP 1999) (ALTERNATE II—SEP 1999).

10. Forest Service Specifications referenced in the item purchase descriptions (IPDs) can be found on the website at http://www.fs.fed.us/t-d/programs/fire/specs.htm.

11. A subcontracting plan in accordance with FAR Clause 52.219-9 will be required and reviewed, as applicable. An offeror, other than a small business concern, submitting a proposal that exceeds $650,000 shall submit a subcontracting plan with its initial offer.

12. Three first article samples of each NSN are required 60 days after notice of award for all items. The delivery schedule for the production terms will be 120 days after receipt of order (ARO) or after receipt of the First Article Inspection Approval by the Contracting Officer. Deviation from the required delivery schedule may result in your offer being considered non-responsive and no longer considered for possible award.

13. Note: change in Clause 52.211-16, Variation in Quantity (b) now reads the permissible variation shall be limited to:

0 percent increase on Direct Delivery Orders and 3 percent increase on deliveries to GSA depots

0 percent decrease on Direct Delivery Orders and 0 percent decrease on deliveries to GSA depots.

This increase or decrease shall apply to the quantities specified in each order issued under any contract resulting from this solicitation.

14. Evaluation Criteria: Offers will be evaluated and the Government will award a contract based on the lowest price technically acceptable offer. Past performance information from available sources will be evaluated to determine responsibility. All offers must conform to the solicitation to be determined responsive for consideration for possible award. (See pages 71 - 72)

15. Technical Data Required with Offer Submittal and Price for Evaluation: Offerors are advised that the required data described herein will be utilized for review and evaluation to determine technical acceptability and responsibility for possible contract award. The Government will not make assumptions concerning the offeror's intent, capability, facilities, or certifications/registrations. Clear identification is the sole responsibility of the offeror. Failure to provide required data may result in offer being determined non-responsive and no longer considered for possible contract award.

- 2 -

A. TECHNICAL CAPABILITY:

1. NFPA 1977, Standard on Protective Clothing and Equipment for Wildlife Fire Fighting: The pants shall be third party certified as being in compliance with National Fire Protection Association (NFPA) Standard 1977, Protective Clothing and Equipment for Wildland Fire Fighting, 2011 Edition. Proof of this certification (2011 Edition) shall be presented at the time of First Article submission. Evidence of obtaining third party certification to NFPA 1977 (2011 Edition or the 2005 Edition) on similar or like products in offeror's current product line is required at offer submittal for technical acceptability evaluation determination. Failure to show evidence of obtaining NFPA certification at time of offer submittal may result in your offer considered non-responsive and no longer considered for possible award.

2. ISO 9001, Quality Management Systems - Requirements: In order to submit an offer, manufacturers must be registered to ISO 9001, Quality Management Systems - Requirements, at the time of offer submission. Evidence of current ISO registration is required as part of an offer submission. Failure to show evidence of registration at time of offer submittal may result in your offer considered non-responsive and no longer considered for possible award.

3. Letters of Commitment: Offerors must submit letters of commitment at the time of offer submission for required materials in the Item Purchase Descriptions (pages 9 - 22 in the solicitation) and Forest Service specifications and drawings referenced therein and as identified below. Letters of commitment must be on the supplier's letterhead and must identify and address the following six elements:

1 - Supplier’s commitment to provide materials as specified in the below Forest Service Specifications in sufficient quantities to support Government monthly potential quantities:

6 - Marking, Packaging, Packing, Palletization and Stacking requirements Failure to identify and address all materials specified in accordance with all requirements and the six elements listed below may result in offer considered non-responsive and no longer considered for possible award.

4. Facilities Inspection: Technical capability may also be determined by a pre-award assessment report (PAR) conducted by GSA personnel at the offeror's facility. The assessment will include, as a minimum, offeror's facility capacity, quality assurance system, and demonstration of compliance with all requirements. Failure to receive an overall recommendation of "Capable of Performing" the requirements of a resulting contract, if awarded, may result in the offer no longer being considered for award.

B. PRICE. Items will be awarded in the aggregate. Prices for each item must be entered in the Schedule of Items on pages 5 - 8. Any award price must be determined fair and reasonable by the Contracting Officer.

16. Failure to meet any element may result in your offer no longer being evaluated/considered for possible award.

17. Additional information provided for clarification.

(1) The Item Purchase Descriptions on pages 9 - 22 of this solicitation were revised 5/25/2011 to update

a. color from Spruce Green to Sage Green in accordance with Forest Service Specification 5100-88E, PARA 3.4. and

b. add exception to Forest Service Specification 5100-92M PARA 2.2 and PARA 3.2.10.1 to update NFPA 1977, Standard on Protective Clothing and Equipment for Wildland Fire Fighting from the 2005 Edition to the required 2011 Edition. Proof of certification for the 2011 Edition shall be presented at time of First Article submission (60 days after notification of contract award by the Contracting Officer).

(2) The drawings for these items are .dwf files. The link for the Autodesk web site is http://usa.autodesk.com/

The dwf viewer file called Acad design review may be downloaded free from this site to open the dwf files and provide the capablity to plot the files full scale (1:1).

(3) Although FAR Clause 52.212-1(e) allows for multiple offers to be submitted, the method of award is to award to the lowest price technically acceptable offer. Each offer must be submitted separately as a stand-alone proposal. Each offer submitted will be evaluated separately.

(4) Unforseen events may delay a contract award; however, award is expected as soon as possible after the offer due date. FAR Clause 52.212-1(c) states that the offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers to allow sufficient time for contract award.

(5) A specific timeframe is not determined for Government notification of first article approval/disapproval. It is in the Government's best interest to perform the first article inspections in the most expeditious way possible in order not to delay notification any longer than necessary.
