The contractor is responsible for all supplies, equipment, safety compliance per OSHA regulations (CFR 29 Parts 1910 and 1926), site-specific Health and Safety Plan development, protection of underground and overhead utilities, daily cleanup of non-tree debris, damage repairs, work area security, and trail closure during operations. Standard work hours are Monday through Friday, 6:00 AM to 4:30 PM, coordinated with the FAA Contracting Officer's Representative. FEDERAL AVIATION ADMINISTRATION SCOPE OF WORK

TREE ARBORIST TRIMMING

QRV ATCBI

Project Location: Lat/Long 35.867380/-84.894419

3405 Owl Roost Rd, Crab Orchard, TN 37723

1. STATEMENT OF WORK

Actions are necessary to clear trees and tree limbs located on the property of the Justin P. Wilson Cumberland Trail State Park which are obstructing the line of sight for L3Harris Technology’s Microwave data path. The lease agreement with the State of Tennessee allows the FAA to clear tree obstructions up to 1000 feet from the FAA leased property.

1. As observed by an L3Harris representative positioned at the microwave dish on the QRV ATCBI beacon tower, cut all tree limbs and if necessary, trees that may not survive trimming which are obstructing the L3Harris microwave path up to 1000 feet from the leased property.

Clear any fallen material from road or established trails that could cause a trip hazard or trail blockage.

2. The work will proceed under the oversight of the FAA COR and L3Harris representative until satisfactory clearing of the pathway has been achieved.

3. The cut limbs, brush, and small debris will be mulched and disposed of in a location approved by the state of Tennessee. Logs will be cut into salvageable lengths and placed in an area approved of by the State of Tennessee.

4. Individual trees to be trimmed or removed shall be identified and priced in following two categories:

1.) <12” dbh

2.) 12-24” dbh.

Note: It is anticipated that no more than 25 trees from each category will be necessary to clear the path. Should it become apparent that the work will be more extensive than that, the Contractor should immediately advise the Contracting Officer and the COR for further guidance prior to proceeding.

5. Removal of trees and/or brush 3 inches or less in diameter may be required to access the removal area. Removal of this vegetation is considered incidental to the required objectives of this Statement of Work (SOW).

6. Any tree, as determined by a licensed arborist, that is not anticipated to survive extensive trimming, shall be felled and stumps shall be ground to below ground level.

7. The Contractor must protect underground or overhead utilities. The Contractor should expect to work Monday through Friday during the daytime hours of 0600 AM to 1630 PM unless alternatively coordinated in advance with the COR. Coordination between the Contractor and the COR shall be required at all times in order to ensure microwave path is completely clear of tree obstructions.

8. All work should be performed under the supervision of an arborist licensed in the state of Tennessee. The Contractor must have an arborist onsite during the trimming and removal of trees.

9. Trees to be affected by this work must be identified and marked prior to any cutting or trimming, the anticipated trees should be marked for review by a representative of the State of

Tennessee. This should happen within 30 days of receiving the NTP so the State Parks Representative can have adequate time to review.

2. SPECIAL REQUIREMENTS

1. Per US Fish and Wildlife Service this work must occur between during the timeframe of October 1st and March 31st to avoid negative impacts on critical species indigenous to the area.

3. SITE ACCESS/CONSTRUCTION LIMITS

1. The FAA ATCBI site is located at the dead end of Black Mountain Road near the Black Mountain Trail head parking lot of the Justin P Wilson Cumberland Trail State Park. Black Mountain Road is paved but narrow and steep with overhead utilities crossing the road in several places. The FAA facility is a 24-hour unmanned operational Air Traffic Control support facility surrounded by a steel chain link fence. The work to be completed by the Contractor is near the entrance to the FAA facility on land of the Justin P Wilson Cumberland Trail State Park.

2. Coordination will be required with onsite FAA COR and L3Harris during cutting and trimming to ensure the microwave path is clear. The limits of work shall be constrained to the direct path of the radar + or – 50’ out to 1,000 feet from the facility.

3. Contractor shall confine operations, activities, storage of materials and employee parking within areas as designated by the COR. Additional space the Contractor deems necessary shall be obtained off site, at no additional cost to the Government.

4. Contractor must ensure trails affected by work area are closed during work activities.

5. Damage to existing driveways, fences and utilities caused by the Contractor's activities shall be repaired immediately. All costs of repairs shall be paid by the Contractor. After notice to proceed and prior to the commencement of work, the Contractor and COR shall conduct joint inspections of the areas affected by this work. Existing damage or defects shall be noted and will be used as the basis for determination of damages caused by the Contractor's operations.

6. It is strongly urged that the Contractor carefully examine the premises to determine the extent of work and the conditions under which it must be done.

7. The Government reserves the right to enter the work area at any time for work inspection and for the operation of the facility.

8. All work hours, shifts, and overtime work shall be coordinated with the COR. Before commencing work on site, furnish to the COR a statement of hours per day and days per week to normally be worked and approximate number of people on the job for a normal work shift.

4. SECURITY

At the end of each workday, Contractor shall secure all work areas by closing and locking all doors and gates. Contractor is responsible for the security of the staging area and shall provide the required measures at no additional expense to the government.

5. PERSONNEL

Contracting Officer -The term "Contracting Officer" (CO) as used herein denotes the person designated to act on behalf of the Government in the performance of this contract. Where reference is made to "Federal Aviation Administration" (FAA), "Contracting Officer's Representative" (COR), or the like, this shall mean the Contracting Officer or his/her authorized representative.

Contractor Superintendence - In accordance with Contract Clause entitled SUPERINTENDENCE BY THE CONTRACTOR, the Contractor shall at all times during performance of this contract and until the work is completed and accepted, directly superintend the work or assign and have on site a competent superintendent with the authority to act for the Contractor.

The Contractor shall submit a Project Organizational Chart with the key personnel identified and their qualifications for the Government’s review and approval.

The Contractor and his employees shall be subject to all rules and regulations relative to entering and leaving the FAA facility.

6. COORDINATION

The Contractor shall coordinate all work which has any or may have any impact on any operational system within the facility through the COR. The Contractor shall immediately cease any work which is adversely impacting the operation of the ATCBI facility.

7. SAFETY REQUIREMENTS

Contractor Responsibility

1. General Safety Provisions - The Contractor shall bear full responsibility to provide safe working conditions for its employees and Contractors. The Contractor shall not permit any employee or Subcontractor to work in surroundings or under working conditions that are unsanitary, hazardous, or dangerous to the health and safety of the employee.

2. Accident Prevention - The Contractor shall bear the responsibility of maintaining an accident prevention program such that frequent and regular inspections of the job site, materials and equipment are made by a competent person designated by the employer.

3. Use of Equipment - The Contractor shall not permit the use of any machinery, tool, material, or equipment that is not in compliance with OSHA regulations. The employer shall permit only those employees qualified by training and/or experience to operate equipment and machinery.

4. The FAA shall not be held responsible for safety inspections to ensure Contractor conformance with the OSHA safety regulations. The FAA, however, reserves the right to notify the Contractor of any deficiencies regarding worker safety.

5. The FAA will evaluate the Contractor on its safety performance, including that of its Subcontractors. The number and severity of safety and security violations will be considered in this evaluation. Contractor safety violations are cause for termination for default.

OSHA Regulations

The Contractor shall comply with the latest Occupational Safety and Health Administration regulations (CFR 29 Part 1926) regarding safety in the work area.

The Contractor shall be responsible for obtaining copies of non-FAA referenced documents without additional cost to the FAA. If Contractor requests a copy of FAA directives, they may be obtained by contacting the Contracting Officer.

The Contractor is not relieved from adhering to other OSHA requirements not listed herein. The Contractor shall consult the latest referenced OSHA documents for safety regulations.

Safety Plan

The Contractor must develop and implement a site-specific comprehensive Health and Safety Plan (HASP) based on the scope of work, for his or her employees as well as others in the area and the properties around. It shall cover all aspects of onsite work operations and activities associated with the contract. This plan must comply with 29 CFR 1926, FAA Order 3900.19B, other applicable health and safety regulations and any project-specific requirements. The Contractor must provide the Contracting Officer with a copy of this plan. Acceptance of the Contractor's HASP only signifies that the plan generally conforms to the requirements of the contract. It does not relieve the Contractor of the responsibility for providing with a safe and healthful work environment.

At a minimum the HASP shall address the following:

Workplace address Name and address of the principal Contractor Key Personnel, phone #s and addresses Estimated duration of the work Hazard assessment and identification of the hazards in the scope of work Mitigation of hazards and proposed control measures for the risks Hazard Communication methods How the controls will be implemented Personal Protective Equipment Training Temperature Extreme Medical Surveillance Exposure Monitoring and Air Sampling Site Control Emergency Response/Contingency Plan Emergency Action Plan Arrangements for monitoring and reviewing controls

The plan must be written so it is easy to understand, signed and dated by the General Contractor. It must be available for the length of the project. The General Contractor will not be allowed to start on-site until the plan has been discussed with or a copy given to all relevant people and the plan is readily available for inspection. The plan must be amended if there are changes in how risks will be managed.

The General Contractor must inform any affected person of the change.

8. CLEAN-UP

The Contractor shall correct or repair any damage done during any part of this contract. Non-tree/limb scrap and debris resulting from the project shall be removed from the site after each day’s work on site. All non-tree/limb debris and generated waste shall require disposal in a manner that is not in conflict with local sanitary regulations.

9. SUPPLIES AND EQUIPMENT

The Contractor shall furnish all supplies and equipment as specified to accomplish the contract specifications.

SHIPPING AND RECEIVING MATERIAL. FAA shall not be responsible for shipping or receiving any equipment relating to this contract nor shall the Contractor ship or otherwise receive any materials at the expense of the FAA.

STORAGE OF MATERIALS. Onsite storage must be coordinated with the COR prior to starting work, so that the roadway is not blocked.

C. Pre-Bid Site Visit: All interested Contractors will be invited to view the site conditions prior to bidding. All expenses for the recommended site visit shall be the responsibility of the Contractor.

The U.S. Government shall not reimburse any expenses incurred for the purpose of soliciting bids for this contract.

11. ACCEPTANCE OF WORK

The FAA COR will conduct an inspection at the completion of the project to ensure that all items of the contract have been fulfilled and that the site has been cleaned of non-tree debris.
