About this file
This document contains the Special Terms and Conditions for a contract opportunity with the Virginia Department of Forensic Science (DFS) and the Commonwealth of Virginia. The contract covers the provision of products and services, with the Commonwealth reserving the right to request additional information, limit advertising, conduct audits, and make awards to the lowest responsive and responsible bidder that is a DSBSD-certified micro or small business, if certain criteria are met. The contract period is unspecified, with an ordering option for the DFS to place additional orders within the first 60 days. The solicitation requires bidders to provide detailed product information and identifies requirements related to energy-efficiency, water-efficiency, and recycled content in plastic materials.
The pricing terms stipulate that bid prices must be firm unit prices, with no extra charges allowed. The Commonwealth reserves the right to reject any and all bids, waive informalities, and delete items prior to award. Discounts for prompt payment will not be considered in the award decision. The bid acceptance period is 120 days, after which the bid may be withdrawn.

SPECIAL TERMS AND CONDITIONS
1. ADDITIONAL INFORMATION: The Commonwealth reserves the right to ask any bidder to submit information missing from its bid, to clarify its bid, and to submit additional information which the Commonwealth deems desirable.
2. ADVERTISING: No indication of such sales or services to the Virginia Department of Forensic Science (DFS) and/or the Commonwealth of Virginia will be used in product literature or advertising without the prior, written consent of DFS. The Contractor shall not state in any of its advertising or product literature that the Commonwealth of Virginia or any agency or institution of the Commonwealth has purchased or uses its products or services without the prior, written consent of DFS.
3. AUDIT: The contractor shall retain all books, records, and other documents relative to this contract for five (5) years after final payment, or until audited by the Commonwealth of Virginia, whichever is sooner.
The agency, its authorized agents, and/or state auditors shall have full access to and the right to examine any of said materials during said period.
4. AWARD: The Commonwealth will make the award(s) on a grand total basis to the lowest responsive and responsible bidder that is a DSBSD-certified micro business if such a bid is received, provided that the bid is up to and including $10,000 and the agency in its sole discretion determines that the bid price is fair and reasonable. Otherwise, award of the contract shall be made to the lowest responsive and responsible bidder that is a DSBSD-certified small business if such a bid is received, provided that the bid is not more than $100,000 and the agency in its sole discretion determines that the bid price is fair and reasonable. If, in the agency’s opinion, the criteria in the previous two sentences are not present, then award shall be made to the lowest responsive and responsible bidder of any size, provided the agency in its sole discretion determines that the price is fair and reasonable. If applicable, unit prices, extensions and grand total must be shown. In case of arithmetic errors, the unit price will govern. If cash discount for prompt payment is offered, it must be clearly shown in the space provided. Discounts for early prompt payment will not be considered in making awards. The State reserves the right to reject any and all bids in whole or in part, to waive any informality, and to delete items prior to making an award.
5. BID ACCEPTANCE PERIOD: Any bid in response to this solicitation shall be valid for (120) days. At the end of the days the bid may be withdrawn at the written request of the bidder. If the bid is not withdrawn at that time it remains in effect until an award is made or the solicitation is canceled.
6. BID PRICES: Bid shall be in the form of a firm unit price for each item during the contract period.
7. eVA ORDERS AND CONTRACTS: The solicitation/contract will result in one (1) purchase order with the applicable eVA transaction fee assessed for each order.
8. ENERGY-EFFICIENT AND WATER-EFFICIENT GOODS: When an agency or institution receives two or more bids for products that are Energy Star certified, meet the Federal Energy Management Program (FEMP) designated efficiency requirements, appear on FEMP’s Low Standby Power Product List; or are WaterSense certified, the agency or institution shall only select among those bids.
9. EXTRA CHARGES NOT ALLOWED: The bid price shall be for complete installation ready for the Commonwealth’s use, and shall include all applicable freight and installation charges; extra charges will not be allowed.
10. INSTALLATION: All items must be assembled and set in place, ready for use. All crating and other debris must be removed from the premises.
11. ORDERING OPTION: The Department of Forensic Science, may during the first sixty (60) days after this contract is awarded, with the concurrence of the contractor, place additional orders under the contract at the original unit price through the issuance of separate purchase orders. The aggregate of such additional orders shall not exceed 100% of the quantity originally stated in the contract.
12. PLASTIC MATERIALS: Bidders must identify whether their plastic materials contain recycled materials and, if so, specify the amount of recycled content in such plastic materials.
13. PRODUCT INFORMATION: The bidder/offeror shall clearly and specifically identify the product being offered and enclose complete and detailed descriptive literature, catalog cuts and specifications with the bid/proposal to enable the Commonwealth to determine if the product offered meets the requirements of the solicitation. Failure to do so may cause the bid/proposal to be considered nonresponsive.
14. QUANTITIES: Quantities set forth in this solicitation are estimates only, and the contractor shall supply at bid prices actual quantities as ordered, regardless of whether such total quantities are more or less than those shown.
