On page 29, it states this requirement:

"Consultant Fees and Contracts - Common examples include lecture fees, honoraria, travel and per diem for outside speakers or independent evaluators, and subject-matter expert consultants.

· Describe the nature of the contract/consultancy and list number of people and rates

· Fees and rates should be consistent with the level of experience and based on a fair market value.

· Fees and honorarium should not exceed $698/day per person, effective January 1, 2021."

We are a consulting company and it would be our consultants who would be working on this grant were we to win it. Fees for our consultants do not fit into a $698 daily limit. I think this passage is referring to ancillary consulting fees like hiring a speaker, but it does reference "subject - matter experts." Our consultants are all subject matter experts in their specific space disciplines. They are not technically employees, and may work also for other companies.

It sounds like the SMEs referenced would be considered key personnel on the grant as they would be performing core programmatic direction and technical value, and would therefore have to be employees of the non-profit. Key personnel are designated by the recipient organization and are responsible for the design, management, or execution of a project. For-profit companies are not eligible to be grant recipients; however, if your organization has 501(c)3 status, the SMEs could be included as key personnel as part of the 501(c)3.

The consultant services could not be included in the Contractual section of the budget as this section cannot include consultancy contracts, per 2 CFR 200.1 Contract. However, if the SMEs are working as consultants on discrete activities (such as a lecture, speaking engagement, etc.), as described on pg. 29, Category F. Contractual of the NOFO, their fees/honoraria could be included there, not to exceed $784.62/day per person (this was increased from $698/day effective January 2024; we will have to correct this in the NOFO). These consultant fees/honoraria could be captured in the budget and budget narrative as its own line item, separate from the key personnel and contractual sections.
