| Question | Government Response | |
| 1 | Being a large business, is it possible for us to work with this SBA company on this opportunity? |
| Yes, there are some possibilities for a large business to work with a small business prime contactor on this small business set aside consistent with the regulations and the terms and conditions of the RFP. | |||
| 2 | If so, could you possibly give me a brief description of how? | While we cannot advise companies in these types of business decisions. The rules are complicated and fact specific and governed by the prime. (see FAR 19.601(d)), see 13 CFR 125.6, and 13 CFR 125.1) See e.g. | |
| 3 | Is it as easy as the SBA just has to own over 51% of the cost? | No, it is not as easy as having the small business owing “over 51% of the cost” as these situations get very complex. There are many variables at play which could impact the determination and the variables will depend on what the SB firm plans to do and what the solicitation requires. |
