About this file

This document is a Bid Questions and Responses record from the Florida Department of Transportation (FDOT) dated November 5, 2025, addressing inquiries related to two invitation to bid solicitations (DOT-ITB-26-3009-SC and DOT-ITB-26-3010-SC) for deicer pellets and liquid deicer products. The procurement requires bidders to supply products as specified with no alternative products accepted. The initial contract term is 12 months with the option for renewal for up to an additional 12 months, provided the renewal period does not exceed the original term length. Geographic coverage is divided into sections, with Sections A-D covering Midway, Milton, Marianna, Panama City, and Ponce de Leon, while Sections E and F expand coverage to include those same locations plus Lake City, Chiefland, Perry, St. Augustine, and Jacksonville. Historical usage data for the past five years shows significant variability in demand, ranging from zero gallons and pellets in certain fiscal years (2024-2025 and 2021-2022) to 27,720 gallons and 54 pellet super sacks in the 2025-2026 period, with intermediate years showing 4,602 and 6,000 gallons respectively.

FDOT has clarified that no price adjustments will be permitted in option years regardless of raw material fluctuations, and payment terms are governed by Section 3 Compensation and Payment, Item B of the Purchase Order Terms and Conditions. The agency has declined requests for alternative product specifications and has directed bidders to the existing contract terms regarding indemnity, force majeure language, and warranty requirements as referenced in Section 36 Terms and Conditions (PUR 1000) and Section 10 Warranty/Substitutions of the Invitation to Bid. Payment terms are specified as NET 30 according to the referenced Purchase Order Terms and Conditions document.
