NSWCCD Sole Source/Brand Name Justification Under SAT Rev 4 Template Effective November 2023

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address) XE-3-HDSE manufactured and sold exclusively by Q-labs will be utilized to monitor air temperature, relative humidity, ultraviolet degradation in support of corrosion studies. It is intended to be installed in Building 60 Code6130 lab spaces. Code 613 is procuring 2 full XE-3-HDSE and supporting equipment as shown in the table below.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
Q-Sun XE-3-HDSE produced by Q-Labs is necessary due to this model being a full-size flat array tester with three air-cooled Xenon lamps that last 3000 hours at typical irradiance. The XE-3-HDSE model allows precise control of the relative humidity while having the capability to dual spray a secondary solution e.g. soap, acid, or purified water. The X-1800+ and UV filter Daylight – Q produces realistic reproduction of full- spectrum sunlight, including ultraviolet, visible light, and infrared radiation.
This system has been shown to be historically accurate and able to withstand the intended highly corrosive environments that we will be exposing it to. This Testing chamber allows for continuous collection of data in a safe, secure and non-connected format.

Q-labs has proprietary rights to and is the only producer/vendor of the XE-3-HDSE.
