About this file
This is a Questions and Answers document issued by the Florida Gaming Control Commission (FGCC) in response to bidder inquiries regarding RFP No. FGCC-25/26-11 for Independent Testing Lab Services. The RFP seeks a qualified contractor to provide forensic inspection and expert witness services for gambling devices, including slot machines and video poker machines, in support of the FGCC's regulatory and investigative functions. The RFP clarifies that the procurement does not establish an exclusive independent testing laboratory for slot machine manufacturers and distributors, but rather procures forensic inspection and expert testimony services exclusively for FGCC use. The vendor may be required to perform forensic inspections to determine whether gaming machines meet the definition of a slot machine under Florida Statutes and to ensure compliance with Chapter 551, Florida Statutes, and Rule Chapter 75-14, Florida Administrative Code. The testing scope includes laboratory certification testing of slot machine games, in-field testing and audits of installed slot machine games, and additional testing requested by FGCC following initial lab certification. The written question submission deadline was April 22, 2026, at 5:00 p.m. Eastern Time, with proposals due June 2, 2026, at 5:00 p.m. Eastern Time and public opening scheduled for June 3, 2026, at 2:00 p.m. The anticipated Notice of Intent to Award is June 22, 2026, and the contract term is two years with potential renewal for up to two additional years, with an estimated start date of July 1, 2026.
The Q&A document addresses conflict of interest and competition concerns by confirming that award of the contract does not preclude the vendor from bidding on and performing other testing or consulting services in the future. The document clarifies that vendors may decline specific forensic evaluation or expert testimony opportunities if conflicts of interest or liability concerns exist, subject to the provisions outlined in Section 39 of the Draft Contract and the Conflict of Interest Certification requirements. The evaluation criteria comprises an 80-point technical proposal and 20-point cost proposal, with an anticipated annual spending cap of $200,000 and no minimum guaranteed spend. The contract is structured as a fixed-price agreement with cost evaluation using the present value methodology required by Florida Statutes. No set-aside designations or restrictions on organization types are specified in the procurement.

Questions and Answers https://flgaming.gov/
Questions and Answers
The Commission has received the following questions, and the Commission’s answers are provided in the table listed below:
No. Question Answer
1 Section 1.1 states one of the services as aiding the FGCC to “conduct independent tests of slot machines as outlined in Rule 75-14.038(1)”.
With that in mind:
o Considering FGCC intends to award one contract, does this mean FGCC is looking for a sole provider of independent lab testing and certification?
No. RFP No. FGCC-25/26-11 seeks to procure forensic inspection and expert witness services for FGCC only. The RFP does not, and any resulting contract will not, apply to slot machine certification services provided for slot machine manufacturers and/or distributors under Rule 75-
14.038 of the Florida Administrative Code. In other words, FGCC is not seeking to procure an exclusive independent testing lab that all slot machine manufacturers and/or distributors must use for slot machine certification.
Instead, the reference to Rule 75-14.038(1) in Section 1.1 is intended only to describe the requirements that the vendor must consider when performing, at FGCC’s request, a forensic inspection of a slot machine intended to be placed at a slot machine licensee’s facility.
Section 1.1 states one of the services as aiding the FGCC to “conduct independent tests of slot o And if so, is this lab exclusivity limited to the mathematical analysis of slot machine games as described in the referenced section? Or does this lab exclusivity also extend to other elements of slot machine (and systems) testing performed by independent labs?
RFP No. FGCC-25/26-11 is not soliciting an exclusive independent testing lab that all slot machine manufacturers and/or distributors must use for slot machine certification.
Section 1.1 states one of the services as aiding the FGCC to “conduct independent tests of slot o Does the aforementioned testing mentioned refer to the following:
Under the contract, FGCC will require forensic inspections (and expert witness testimony) in two circumstances. First, the vendor may need to perform a forensic inspection of gaming machines to ascertain whether such machines meet the definition of a slot machine under section 849.16, Florida Statutes. Second, the vendor may need to perform a forensic inspection of slot machines operated at a slot machine licensee’s facility to ensure that such machines comply with the requirements of chapter 551, Florida Statutes, and Rule Chapter 75-14 of the Florida Administrative Code. The quoted portion of Section 1.1 of the RFP applies to the latter.
in lab certification testing of a slot machine game
Yes in-field testing/audit of installed slot machine games (e.g., to ensure actual payout is trending towards the minimum RTP in Rule 75-14.038(1))
Additional testing requested by the FGCC after initial lab certification (e.g., Lab A certifies game, FGCC requests Lab B to do additional testing against Rule 75-14.038(1))
2 Will the awarded company’s participation preclude it from bidding on and performing other testing or consulting services in the future?
No. Please refer to section 39 of Attachment F, FGCC Draft Contract and Attachment J, Conflict of Interest Certification.
3 If a conflict of interest or liability concern is foreseen in performing a specific forensic evaluation or providing certain expert testimony support, would it be acceptable to decline that specific opportunity?
Please refer to section 39 of Attachment F, FGCC Draft Contract and Attachment J, Conflict of Interest Certification.
