PERFORMANCE WORK STATEMENT (PWS)

PEARL HARBOR NAVAL SHIPYARD & INTERMEDIATE

MAINTENANCE FACILITY (PHNSY&IMF)

PROGRAMMING SERVICE FOR SECURITY ENCLOSURE DOOR

Part 1

General Information

1. GENERAL:

PHNSY&IMF is a US Navy regional industrial center located on the island of Oahu, Hawaii. It provides the resources and industrial services necessary to maintain, repair, and overhaul US Naval Vessels in the Pacific Region. The Submarine Maintenance Enclosure (SME) is a custom designed piece of equipment used by PHNSY&IMF. One of the SME’s key features is a motorized, two (2) section Roof Structure that opens and closes; PHNSY&IMF has recently replaced the two servo drives control the stop/start of the Roof Structure and need the OEM to program the new drives.

1.1 Description of Services/Introduction:

The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform technical services to the Shipyard for the programming of two (2) new drives within this Performance Work Statement. The contractor shall perform to the standards in this contract.

1.2 Scope:

1.2.1 OVERALL OBJECTIVE: The awardee, hereafter referred to as the Contractor, shall provide technical services to the Shipyard to:

1.2.2 Program two (2) new servo drives such that the opening and closing of the Security Enclosures Roof Structure is returned to original manufacturing specifications.

1.2.3 The servo drives are of the following make and model:

Allen-Bradley, 2098-DSD-150X Series B, Ultra 3000 W/Indexing, 65A/150A.

1.4 Contractor Qualifications/Requirements:

1.4.1 The Contractor shall be an Original Equipment Manufacturer (OEM) or authorized OEM repair facility capable of providing technical engineering and troubleshooting services. Certificates shall be provided upon request by the Contracting Officer.

1.4.2 The Contractor and its representatives shall be trained in and comply with all Federal, State, Territorial and local environmental laws and regulations. In the event that the work is found noncompliant to all stated environmental laws and regulations, the contractor shall indemnify the U.S. government from any liability.

1.4.3 Contractor is required to comply with Public Law 105-270, Section 5 (2)(A). This law states that contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public

Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2)(B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter- intelligence operations. Per Section 5(2)(C), inherent governmental functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials or (ii) any function that is primarily ministerial and internal in nature.”

1.4.4 The Contractor shall have experience with Department of Defense (DoD) directives, regulations, policies and procedures.

1.5 Recognized Holidays:

Working Hours: Regular working hours shall consist of an 8-hour period, between 6:30 AM - 3:00 PM, 2nd shift 0230 PM-11:00 PM, or 3rd shift 10:30 PM-0700 AM Monday through Friday, excluding Federal holidays.

FEDERAL HOLIDAYS:

New Year's Day 1st of January Dr. Martin Luther King's Birthday 3rd Monday in January President's Day 3rd Monday in February Memorial Day 5th Monday in May Independence Day 4th of July Labor Day 1st Monday in September Columbus Day 2nd Monday in October Veteran's Day 11th of November Thanksgiving Day 4th Thursday in November Christmas Day 25th of December

If the federal holiday falls on a Saturday, the holiday is observed on the preceding Friday. If the federal holiday falls on a Sunday, the holiday is observed on the following Monday.

Note: 2nd shift, 3rd shift, overtime, and weekend work can only be approved by the COR or KO of this contract.

1.5.1 Hours of Operation:

The contractor is responsible for conducting business, between the hours of 6:30AM-3:00PM Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.5.2 Place of Performance:

The work to be performed under this contract will be performed at government facility at Pearl Harbor Naval Shipyard &IMF.

1.6 Security Requirements:

Contractor personnel performing work under this contract must submit request to JPAS - Joint Personnel Adjudication System and obtain approval for FMB pier and Naval Vessel access.

1) This contract does not require a security clearance level and clearance granted by the Defense Security Service (DSS). However, Contractor personnel shall recognize that PHNSY & IMF deals with sensitive information and other proprietary information, which are valuable, special, and unique assets. Contractor personnel shall not divulge, disclose, or communicate in any manner, any information to any third party without prior written consent. Contractor personnel shall protect information and treat it as strictly confidential and will abide by the security requirements of SECNAVINST 5510.36. A violation of this paragraph shall be a material violation of this agreement.

2) Additionally the Contractor personnel shall follow all procedures in requesting and obtaining a PHNSY & IMF “Green” standard access control badge for all Contractor personnel performing work. Sufficient time shall be allowed by the Contractor to obtain the necessary badges prior to work.

3) Should Contractor personnel receive or suspect they have learned of classified information beyond their level of clearance, the Contractor shall identify and report suspicions to the COR.

Contractor employees shall clearly identify themselves as a Contractor (i.e. company shirt, pin, visible company identification) in a visible location on the front of exterior clothing and above the waist, (except when safety or health reasons prevent such placement) as to who their employer is.

Identification badges shall be worn at all times when performing work, including while attending Government meetings and conferences that may take place outside the facility.

Contractor is to abide by the following attachments:

Appendix 3- Security Requirements

1.6.1 PHYSICAL Security:

Confidentiality: This project, all materials provided to the Contractor by the Government, test results, conclusions, and recommendations obtained thereof from the Contractor shall be considered Government property. The information shall not be disclosed, copied, modified, used (except to fulfill contract requirements) or otherwise disseminated to any other person or entity at any time to include, but not limited to, inclusion in any database external to the Government without Government’s express consent

1.6.2 Badges/DBIDS/CAC Cards:

The Contractor shall establish and implement methods of making sure all Badges/DBIDS/CAC Cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. No Badges/DBIDS/CAC Cards issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued Badges/DBIDS/CAC Cards by personnel who no longer require access to security areas. The Contractor shall immediately report any occurrences of lost or no longer needed Badges/DBIDS/CAC Cards to the Contracting Officer..

1.7 Post Award Conference/Periodic Progress Meetings:

The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5.

The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.8 Identification of Contractor Employees:

All contract personnel attending meetings, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.9 Contractor Travel

Contractor will be authorized travel expenses consistent with the substantive provisions of the Joint Travel Regulation (JTR) and the limitation of funds specified in this contract. All travel requires Government approval/authorization and notification to the COR.

1.10 Data Rights

The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

1.11 Enterprise Wide Contractor Manpower Reporting Application

The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via a secure data collection site.

Contracted services excluded from reporting are based on Product Services Codes (PSCs).

The Excluded PSCs are:

(1) W, Lease of Equipment;

(2) X, Lease/Rental of Facilities;

(3) Y, Construction of Structures and Facilities;

(4) S, Utilities ONLY;

(5) V, Freight and Shipping ONLY.

The Contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.”

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1 DEFINITIONS:

2.2 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.3 CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.4 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.5 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.6 DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.7 PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.8 QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.9 SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.10 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.11 WORK WEEK. Monday through Friday, unless specified otherwise.

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 Personnel: The Contractor shall furnish sufficient qualified personnel to perform all work specified within this contract.

4.2 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.3. Materials: The Contractor shall furnish materials, supplies, and equipment necessary to meet the requirements under this PWS.

4.4. Equipment: The Contractor shall furnish equipment needed to meet the requirements under this PWS.
