PERFORMANCE WORK STATEMENT (PWS)
Part 1 General Information
1. General: This is a non-personal services contract to provide human role model (caprine) disposal. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: This requirement is for the pickup and disposal of caprine after Live Tissue Training (LTT) events in support of 10th SFG (A) training objectives.
Disposal must occur IAW with all state and federal regulations and prevent consumption of carcasses by any person or wildlife. In accordance with the Colorado Solid Waste Act (30-20-
100.5 et. seq., C.R.S.),and its implementing regulation 6 CCR 1007-2, along with the Group Surgeon’s direction to not utilize landfill disposal due to possible public exposure, incineration of the caprine is required.
1.2 Background: The 10th SFG (A) 18Ds, Special Operations Medics, must conduct live tissue training (LTT) on a regular basis in order to stay current in tactical combat casualty care (TCCC) procedures. LTT also provides critical life-saving medical skills to other Special Forces operators.
Caprine and swine are the only approved role models for LTT. After completion of training, the caprine must be disposed of properly. Because of the medications used during training, they must be disposed of in a way that precludes their entrance into the food supply and prevents environmental contamination, i.e. incineration.
1.3 Objectives: The basic service objectives is to pick up caprine and dispose of them in accordance with federal, state, and local regulations.
1.4 Scope: The contractor will be responsible for the pickup, transportation, and destruction of deceased caprine following LTT, occurring up to 13 times per year. This is a firm fixed price, base plus four option years contract.

1.5 General Information
1.5.1 Quality Control: The contractor shall establish and maintain a complete Quality Control Plan (QCP) to ensure the services are performed in accordance with PWS and commonly accepted commercial practices. The contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services. The government reserves the right to perform inspections on services provided to the extent deemed necessary to protect the government’s interests. The contractor must control the quality of the services and deliverables provided in support of this task and maintain substantiating evidence that services conform to contract quality requirements and furnish such information to the government if requested.
1.5.2 Hours of Operation: The receiving officer from 10th Special Forces Group (Airborne) will schedule pickups within minimum of 72 hours prior to the desired date. Pickups may occur Monday through Friday (normally Mondays and Thursdays) between the hours of 8AM and 5PM, and may include holidays. Inclement weather may not affect scheduled pickup appointments.

1.5.5 Key Personnel: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 0700 hrs – 1700 hrs, Monday thru Sunday except Federal holidays. These individuals shall be available during business hours up to and throughout the period of performance. The primary point of contact will be appropriately briefed regarding the need for discretion regarding the services provided in this contract. The primary point of contact, and any other involved contractor or subcontractor personnel, will not discuss this contract with non-essential personnel.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1 Definitions:
2.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.
2.1.2 CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government.
Note: The only individual who can legally bind the Government.
2.1.3 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.
Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5 DELIVERABLE. N/A
2.1.6 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7 QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.8 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.9 SUBCONTRACTOR. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the sub-contractor.
2.1.10 WORK DAY. Contractor will provide services on an as needed basis upon request. A recurring schedule will not be permitted.
2.1.11 WORK WEEK. Monday through Friday, unless specified otherwise.
PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:
3.1. The Government will not provide Government Furnished Property, however, the Government is responsible for scheduling pickup appointments no later than 72 hours prior to the desired date, and for informing the contractor for the number of containers that will be needed in order to properly transport the waste. The government is responsible for packaging and loading waste into containers provided by the Contractor, and for assisting in loading the containers into the contractor’s vehicle.

CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 Contractor is required to perform pickup, transportation, and destruction (incineration) of caprine used in LTT in accordance with all federal, state, and local regulations. Contractor responsible to meet with the receiving officer on the agreed-upon date and time with adequate containers in order to transport the waste, as agreed upon prior to the pickup date. Contractor to pick-up and dispose of medical waste for the 10th Special Forces Group (Airborne) medical treatment facilities of five (5) to fifteen (15) TB01, 28-30 Gallon reusable, 4.0 cu ft containers as scheduled. Containers are the property of the contractor. Containers picked-up will vary at each appointment. Total yearly estimated pickup for the year is 65-195 containers.
4.2 Anti-terrorism and Force Protection Requirements: Contractor shall comply with the following
4.2.1 Access and general protection policy and procedures. All contractor employees, including subcontractor employees, requiring access to an Army or USSOCOM controlled installation, facility, or area shall comply with applicable security policies and procedures (provided by the government representative). This includes policies pertaining to the use or prohibition of electronic recorders, devices, cameras, etc. If the Contractor is required lo take photographs or videos on a Government Installation, the Contractor must obtain written permission from the Senior Commander. The contractor shall also provide all information required for background checks to meet installation and facility access requirements to be completed by the installation Provost Marshal Office, Director of Emergency Services, or Security Office. The contractor workforce must comply with all personal identity verification requirements as directed by DoD, HODA, USSOCOM, USASOC and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should Force Protection Condition (FPCON) at any individual facility or installation change, the government may require changes in contractor security matters or processes.
4.2.2. NCIC and terrorist threat data base screening required. All contractor employees, including subcontractor employees, who are not in possession of a current Common Access Card (CAC) will be vetted by the local security office to determine fitness and eligibility for access IAW DTM
09-012, paragraph 2.b(4) to include but not limited to an NCIC Ill and Terrorist Database screening. The Vendor will ensure that the government has sufficient biographical information to conduct said screening including, but not limited to the person's name, date of birth, and social security number.
4.2.3 Pre-screen applicants using E-Verify Program. The Vendor must pre-screen applicants using the E-verify Program (http://www.dhs.gov/E-Verify) website to meet the established employment eligibility requirements. The vendor must ensure that the applicant has two valid forms of government issued identification.
PART 5
PERFORMANCE REQUIREMENTS SUMMARY
5.1 General. The Performance Requirements Summary in this section will be used to measure performance of services for the purposes of determining the continuation of service under this contract and any applicable payment deductions.
The rights of the Government and remedies described in this section are in addition to all other rights and remedies set forth in this solicitation. The Government reserves its right under the "Inspection of Services" and "Termination for Default" clauses of this contract. The Contractor shall not be relieved of full performance of the services hereunder and may be terminated for default based upon inadequate performance of services even if a deduction was previously taken for inadequate performance. Failure to meet standards may result in documentation of performance in the (NCR) Non- Conformance Reports. The COR will recommend when a remedy through the CONTRACTING OFFICER should be initiated to address noted deficiencies.
5.1.1 Individual Tasks and Other Services. Requirements not included in the PRS remain subject to separate quality assurance evaluations. The absence from the PRS of any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the Government under any provision of this contract.
5.1.2 Explanation of the PRS. The PRS has been developed to cover required services rather than the individual performance of tasks. Each listed service will pass or fail based on the acceptability of the tasks, which comprise that service.
5.2 PRS Table. The PRS included in this section will provide the following information:
5.2.1 Column Number 1. Column 1 lists the contract requirements by service outputs which breakdown the contract in areas considered necessary for acceptable contract performance. The Government will measure contract performance in each of these various areas to determine overall performance and contract payment. Each service on the PRS will be evaluate IAW established AQLs. Also provided in this column, is the reference para number (including all subsequent sub-para) of the contract that describes the required service.
5.2.2 Column Number 2. Column 2 lists the contract para (including all subsequent sub-para), which details the standards for each listed service.
5.2.3 Column Number 3. Column 3 lists the Allowable Quality Level (AQL) which determines the maximum allowable degree of deviation from perfect performance that may occur for each listed service before the Contractor will receive less than 100% of the maximum payment for the listed service. Definition of the lot size used as the basis for surveillance and for payment computation purposes is also included in this column.
5.2.4 Column Number 4. Column 4 lists the primary surveillance methods the Government will use to evaluate the Contractor's performance of each listed service.
5.3 Inspection Methods. The Government may use a variety of surveillance methods to evaluate the Contractor's performance. The Government may unilaterally change the type and frequency of inspections as it deems necessary. Both scheduled and unscheduled surveillance will be used to look at the total or parts of performance. Valid customer complaints will not be added to the defective samples found under random or planned sampling for the purposes of deductions in contract payment. The methods of surveillance that may be used are Random Sampling, Planned Sampling, Unscheduled Inspections, and Customer Comments. For the purpose of this contract, the word "sampling" is synonymous with the word "inspection".
5.3.1 Performance Evaluations. The Contractor shall have work complete and ready for inspection in accordance with all terms of the contract. The Government will perform monthly quality assurance inspections to measure overall performance and determine contract payment. Government inspections will be made according to the appropriate surveillance method(s), to compare Contractor's performance to contract requirements and standards. When the Contract Manager is not available during inspection to receive the results, acceptance or rejection of work will be made on the basis of the initial inspection.
5.3.2 Measuring Performance. The Government will use the PRS in this contract as the primary tool to measure contract performance. One defect constitutes failure of one inspection of one service listed on the PRS during an evaluation period.
5.3.3 Acceptable Performance. Contractor performance will be acceptable when all requirements have been met and the number of allowable defects has not been exceeding, whether random or planned sampling techniques were used.
5.3.4 Unacceptable Performance. Services listed on the PRS will be unacceptable and rated defective when the number of recorded defects exceeds the allowable number of defects. Defects will result when performance does not meet contract provisions, or was not IAW contract requirements and standards, or was not completed by the specified time, or was not completed in its entirety. Once a defect has been identified it remains a defect, regardless if it has been corrected.
5.4 Non- Conformance Reports. When a PRS service is defective, the Government will issue the Contractor an NCR. The Contractor shall reply in writing by the suspense date explaining why performance was unacceptable and how recurrence of the problem will be prevented in the future. The Contracting Officer will evaluate the Contractor's explanation and determine if other remedies; e.g., partial payment, or contract termination is applicable.
5.4.1 Re-performance of Defective Work. Except as otherwise provided by this paragraph, the work required by the contract is of such a nature that defective or incomplete performance disclosed by Government inspection is not subject to correction by re-performance or late performance. The Contractor shall not be required or entitled to re-perform, perform late, or otherwise correct defective work for the purpose of avoiding a defect for the day of evaluation
5.4.2 Re-performance Requirements. At the sole election of the Government and upon notification to the Contractor, the Contractor may be required to re-perform or perform late any or all defective work. Where the Government so elects, the Contractor shall be notified promptly after inspection that specified defective work will be re-performed or performed late and completed within the re-performance period specified by the Government. In such cases, the Government will re-inspect work designated for re-performance or late performance.
5.4.3 Conditions of Re-performance. Re-performed work shall comply with same requirements as initial work. The requirement for re-performing defective work will not alleviate the Contractor from responsibility to perform all other work IAW the terms of the contract. The Contractor's original inspection results will not be modified when work is re-performed IAW the contract. The Contractor may be held liable for any damages sustained by the Government; e.g., costs associated with re-inspection.
